WHEREAS, Keith S. Baker and Cheryl L. Baker, husband and wife, of P.O. Box 147,
Walnut Bottom,. Pennsylvania 17266 (hereinafter together called "Owner"}, are about to execute
contemporaneously herewith, a contract with T&J Builders, of 140 Ott Road, Shippensburg, PA
17257 (hereinafter called "Contractor"), far the erection of a dwelling house upon a lot of land
situate and described as follows:
ALL THAT CERTAIN tract of land situate in South Newton Township, Cumberland
County, Pennsylvania, gursuant to a Final Subdivision Plan for Ronald A. Baker Estate, prepared
by Eric L. Diffenbaugh, PLS, bounded and described as follows, to wit:
BEGINNING at a set iron pin along the northeast corner of the fifty foot wide private
right of way as shown on the Final Subdivision Plan of Ronald A. Baker Estate; thence along
lands of said Baker Estate, North 77 degrees 09 minutes 44 seconds East a distance of 330.00
feet to a set iron pin; thence coirtinuing along the same, South 12 degrees 50 minutes 15 seconds
East a distance of 200.00 feet to a set iron pin at the northeast corner of Lot 7; thence along said
Lot, South 77 degrees 09 minutes 44 seconds West a distance of 330.00 feet to a set iron pin
along the easterly line of the fifty foot wide private right of way; thence along said right of way
line, North 12 degrees 50 minutes 1 b seconds West a distance of 200.00 feet to a set iron pin, the
point of BEGINNING.
CONTAINING 1.5152 acres.
'BEING and being intended to be Lot No. 6 on plan of lots of the Ronald A. Baker Estate
Subdivision, South Newton Township, Cumberland County, Pennsylvania, prepared by Eric L.
Diffenbaugh, PLS and recorded on January 23,2009 among the records of the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania at 200901826.
BEING the same premises which Keith Baker and Denise Mancuso, Executors of the
Estate' of Ronald A. Baker, deceased, by their Fiduciary Deed dated January 21, 2009 and
recorded January 23, 2009 in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, to Instrument No. 200901$27, granted and conveyed unto Keith S. Baker and
Cheryl L. Baker, husband and wife.

NOW, this 13~" day of April, 2009, at the time of and immediately before execution of
the principal contract, and before any authority has been given by Owner to Contractor to
commence work on the said building, or to purchase materials for the same, in consideration of
the making of the said contract with Contractor and the further consideration of One and 00/100
($1.00) Dollar, to Contractor paid by Owner, it is agreed that no lien shall be filed against the
above described premises and the building and improvements to be erected thereon, by
Contractor, or any subcontractor, or by any of the materialmen or workmen, or any other person
for any labor provided or materials purchased, or for extra labor provided or materials purchased
for the erection of said building and improvements, the right to file such liens being expressly
waived.
