WHEREAS, Balagopalan Swaminathan and Deepa Swaminathan of 5410 Bonnyrigg Court,
Mechanicsburg, PA 17050, is about to execute contemporaneously herewith, a contract,
with Miller & Lyons, LLC of 5237 E. Trindle Road, Mechanicsburg, PA, for the erection of a
building upon premises commonly known as 6211 Lookout Drive, Township Hampden,
Cumberland County, Pennsylvania, as set forth in the deed dated 02/26/09, recorded at
Document Number 20096548, in the Recorder's Office for Cumberland County,
Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and
attached hereto.
NOW, April 6, 2009, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor
to commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract with Contractor and the further consideration of One Dollar
($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the
building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen
or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly
waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN tract or parcel of land being situate in Township of
Hampden, County of Cumberland and Commonwealth of Pennsylvania, more
particularly bounded and described as follows, to wit:
BEGINNING at a point located on the southerly right of way line of
Lookout Drive, said point being a front property corner of Lot 56;~
thence along Lot 56, South 68 degrees 56 minutes 54 seconds west, a
distance of 201.40 feet to a point; thence along lands now or formerly
of Kenneth Getz, South 56 degrees 11 minutes 15 seconds West, a distance
of 294.03 feet to a point on the northerly right of way of Smith Drive;
thence along said northerly right of way, by a curve to the left having
a radius of 270.00 feet, an arc distance of 307.85 feet being subtended
by a chord of South 74 degrees 09 minutes 31 seconds East, a distance of
291.94 feet to a point; thence along the same, North 73 degrees 10
minutes 40 seconds East, a distance of 265.92 feet to a point; thence
along Lot 58, North 02 degrees 03 minutes 18 seconds West, a distance of
219.63 feet to a point on said southerly right of way; thence along said
southerly right of way, by a curve to the right having a radius of 60.00
feet, an arc distance of 114.62 feet being subtended by a chord of North
75 degrees 46 minutes 37 seconds West, a distance of 97.97 feet to a
point, said point being the point of BEGINNING.
BEING all of Lot 57, Phase~.IV, Signal Hill Residential Development, as
shown on a plan titled "Signal Hill, Tract 1, Final-Phase 9", as
prepared by Melham Associates, PC., dated July 25, 2003 in Plan Book 8~,
Page 136.
