PETITION TO PERMIT TELEPHONE TESTIMONY
AND NOW, this 26th day of March, 2004, comes R. Mark Thomas, Esquire, counsel for
Petitioner Julia Coolidge-Stolz and hereby files this petition requesting the court to permit
telephone testimony at the hearing on the preliminary injunction scheduled for March 29, 2004,
and in support thereof respectfully represents:
1. On March 24, 2004, counsel filed a Petition For a Preliminary Injunction and in
support thereof submitted two (2) letters from physicians in support of the Petition For a
Preliminary Injunction.
2. The court granted a Temporary Restraining Order and_--;~dule~he he, i~r~g on
the issues raised in the Preliminary Injunction for Monday, March 29, 2,004 at 1 :i[~0 p.m."
3. Petitioner has spoken with the two (2) physicians whose testimon~by telephone is
requested, namely, Barry E. Kosofsky, M.D., Ph.D., Director, Massachusetts .~eneraLH0spital
Pediatric Neurology Residency Training Program, and Bruce H. Price, M.D., Chairman of the
Department of Neurology, McLean Hospital, located in Belmont, Massachusetts.
4. Both physicians have expressed their willingness to be available to testify by
telephone during the afternoon of Monday, March 29, 2004.
5. A copy of the Curriculum Vitae of Barry E. Kosofsky, M.D., Ph.D. was attached
to the Petition For a Preliminary Injunction.
6. A copy of the Curriculum Vitae of Bruce H. Price, M.D., is attached hereto as an
exhibit.
9 Denied Respondent Thomas E Coolidge has by no words or actxons of his
own given Petitioner any cause to believe that he is using the Power of
Attorney for his own benefit
10 Demed Petitioner has been conscientiously advised of any gifts made to the
issue of Eleanor U Coolidge by Thomas E Coolidge's Power of Attorney as
Attorney-In-Fact Not only has Thomas E Coolidge not stated to the Petitioner
that he has made testamentary changes, but through bas counsel he has advised
her attorney specifically that as Attorney-In-Fact he has absolutely no power to
change bas mother' s will To the extent that the Petitioner continues to aver that
the Respondent Thomas E Coolidge has changed his mother's will, these
averments are made m bad faith
11 Demed Respondent Thomas E Coolidge never indicated that he made any
changes in the will of Eleanor U Coolidge, but m fact affirmatively stated that
he had no power to do so Any allegation to the contrary Is made m bad froth
12 Denied In fact, Respondent Thomas E Coolidge has shared with Petitioner's
counsel statements of the trust resulting from the estate of Warren Coolidge,
father of all the parties Respondent Thomas E Coohdge also offered to have a
fraud audit conducted at Petitioner's expense concerning all accounts handled

regarding the granting by Thomas E Coohdge of the banjo clock to
bamself has been knowingly made in bad faith,

auction Eleanor U Coolidge had the right to and did withhold various
items from the public auction, and chose not to provide any accounting
to her children during her lifetime,

concerning Eleanor Coolidge's mental capacity as of December 20,
2002, wtuch records will support the fact that she had sufficient capacity

My clinical expertise and research interests, broadly defined as Cognitive/Behavioral Neurology and
Neuropsychiatry, involve the intersection between Neurology,. Psychiatry, Neurosurgery,
Neuropsychology, and Cognitive Neuroscience. I attend' three one-half day clinical outpatient
sessions per week, two at Mol.can l lospital and one at Massachusetts General Hospital. Typical

My teaching commitment includes the direct supervision of 15 psychiatry, neuropsychology,
geriatric, and neurology residents and fellows per year. A McLean/MGH PGY-IV Psychiatry
Resident serves as the Fellow in Neuropsychiatry. I also direct the Ronald Coles Fellowship in
Neurop~;ychiatry at McLean Hospital, a one or two year clinical position open to physicians usually
trained in both neurology and psychiatry. Based at McLean Hospital, my teaching method involves
twice weekly mulfidisciplinary inpatient consult rounds with residents and fellows in psychiatry,
neuropsychology, and neurology evaluating patients with complex cognitive and/or behavioral
disorders.
As Chair of the Department of Neurology and Co-Director of the McLean Neuropsychology and
Psychodiagnostic Testing Center, a considerable amount of administrative time is devoted to
assuring that everything runs smoothly. This involves the coordination of I0 part-time adult and
pediatric neurologists with a FY-2001 outpatient volume of 1,355 patients, inpatient consult volume
of 490 patients, EEG volume of 365, and neuropsychology and psychodiagnostic testing volume of
752. Four major McLean/Massachusetts General l-lospital committee assignments are part of my
administrative duties. I also co-direct the annual McLean Hospital Neurology and Psychiatry Review
Course.
Across Harvard Medical School institutions, I serve as a bi-directional bridge between the McLean
and MGH Departments of Neurology and as a liaison between the McLean and MGH Departments
of Psychiatry. I am the Co-Director of the McLean Hospital/Harvard Center for Neurodegeneration
and Repair 1'ask Force A. I am the neurology representative on the MGH Cingulotomy Assessment
Committee. I have a weekly outpatient clinic at MGH as part of the Cognitive/Behavioral Neurology
Unit and attend on the ward at either MGH or Brigham and Women's Hospital one month per year. I
co-direct a yearly CME Course on dementia with my Partner's colleagues at MGH and Brigham &
Women's Hospital and serve as the neuropsychiatry course director for the MGH/McLean Psychiatry
PGY-IV Biomedical Seminar Series. I also Participate in two efforts based at the Brigham &
Women's Hospital Neurology Department, a summer camp (We Kan Tu) for children and adults
with epilepsy and a program matching high school students with early Alzheimer's patients in
nursing homes (The Eleanor Robbins Community Program: Caring for Each Other). Since 1989, I
have organized monthly lectures at Cambridge Hospital throughout their academic year. I also
participate in the Harvard-wide Mind/Brain Body Institute.
The fi~rther integration of Neurology, Psychiatry, and Neuropsychology is my most compelling
educational mission. My position as Chair of the McLean Hospital Department of Neurology gives

me the "bully pulpit" to convey this message in theory and practice. I have delive'red this message
as an invited lecturer at numerous medical, neurologic, and psychiatric grand rounds throughout the
northeast. I've also advanced this issue as an invited lecturer at major international and national
forums in Cambridge, England, Madrid, Istanbul, Mexico City, Havana, Cuba, Hawaii, Aspen,
Colorado, Chiapas, Mexico, and Riyadh, Saudi Arabia. In this context, I published an article, co-
authored with Drs. Joseph Coyle and Raymond D. Adams, entitle"

m~ssmn. With E.P. Richardson, Jr. as my co-author, I published a CPC regarding Eugene O'Neill
(NEJM 2000;342(I 5):1126-33) which attempts to integrate neurology, psychiatry, psychology, and
neuropathology. In M,,ay 2001, I chaired a workshop at the American Psychiatric Association Annual
Convention entitled, Brain Meets Mind: The McLean Hospital Multidisciplinary Neuropsychiatric
Consult Service." I am a member of a newly formed Harvard Medical School committee Co-
Chaired by Drs. Joseph Martin and Dan Lowenstein whose purpose is to better integrate neurology
and psychiatry at ttarvard Medical School.
