PETITION TO PERMIT TELEPHONE TESTIMONY
AND NOW, comes the petitioner, Julia Coolidge-Stolz, by and through ABOM
& KUTULAKIS, L.L.P., and files this Petition to Permit Telephone Testimony and in
support thereof avers the following:
1. On November 12, 2003, a Petition for Appointment of Temporary Guardian
was filed in the above captioned matter.
2. On November 12, 2003, by Order of Court, a Hearing was scheduled to occur
in the above captioned matter on November 17, 2003, at 9:30AM.
3. On November 13, 2003, subpoenas were prepared and served upon five (5)
separate individuals.
4. Two of the individuals currently under subpoena are physicians, J. CRAIG
JURGENSEN, M.D., and JAMES HEGARTY, M.D.
5. Both of these physicians have appointments scheduled for the time of the
Hearing, but have indicated a willingness to give testimony by telephone.
WHEREFORE, the Petitioner respectfully requests This Honorable Court to
allow Doctor Jurgensen and Dr. Hegarty to deliver testimony via telephone at the Hearing
scheduled to occur Monday, November 17, 2003.

Dear Judge Oler:
I learned this afternoon that a Petition to Permit Telephone Testimony
that was filed earlier today could not be accepted by you because it did not
contain the appropriate indication as to whether the other attorneys involved in
the matter opposed or concurred with the Petition.
I spoke with Attorney Stephen Tiley who informed me that his office is
in opposition to our Petition. In addition, I spoke with Attorney Jackie Smith,
of Saidis Shuff Flower & Lindsay, who informed me that as of Friday
afternoon, November 14, 2003, she did not have authority to concur with our
Petition.
I thank you for your attention to this matter. If you have any questions,
