I live at 151 Sunset Road, Skillman, New 3ersey with my wife, Anne Siemon Banister. FIRST: DISTRIBUTION. I leave all of my real and personal property to my executor for distribution as follows: A. Executor to Pay Funeral Expenses. My executor shall pay the cost of my funeral expenses as soon as may be convenient after my death. B. To my wife, Anne Siemon Banister, I leave my tangible personal property if she survives me by 30 days. I appoint my wife, Anne Siemon Banister, executor of this Will. If she fails or ceases to act, I appoint my son, William Noel Banister, to serve as executor. THE TRUST NAME This trust shall be known as the "MONTGOMERY BANISTER TRUST'. I!. TRUST PROPERTY {A) Property Placed in Trust by Montgomery Banister, called the "grantor" or "trustee", declares that he has set aside and holds in the MONTGOMERY BANISTER TRUST his interest in that property described in the attached Schedule A. The trust propery shall be used for the benefit of the trust beneficiaries, and shall be administrated and distributed by the trustee in accordance with this trust instrument. (B) Additional or after-acquired property may be added to the trust by listing it on Schedule A. lll. RESERVED POWERS OF GRANTOR (A) Admendment or Revocation. The grantor reserves the power to amend or revoke this trust at any time during his lifetime, without notifying any beneficiary. (B) Rights to Trust Property. During the life of the grantor, all rights to income ,profits or control of the trust property shall be retained or distributed to the grantor. (C) Incapacity of Grantor. If at any time, as certified in writing by a licensed physician, the grantor has become physically or mentally incapacitated, the successor trustee shall manage this trust, and shall apply for the benefit of the grantor any amount of the trust income, or trust principal, necessary in the trustee's discretion far the proper health care, support, maintenance, comfort or welfare of the grantor, and his dependent spouse, in accordance with his accustomed manner of living, until the grantor, as certified by a licensed physician, is again able to manage his own affairs, or until his death. Any income in excess of amounts applied for the benefit of thre grantor shall be accumulated and added to the trust property. (D) Grantor's Death. After the death of the grantor, this trust becomes irrevocable and may not be altered or amended in any respect unless specifically authorized by this instrument, and may not be terminated except by distributions permitted by this instrument. IV. TRUSTEES (A) Trustee. The trustee of the MONTGOMERY BANISTER Trust created under this Dec{aration of Trust shall be MONTGOMERY BANISTER. (B) Successor Trustee. Upon the death of the trustee, or his incapacity as certified by a licensed physician, the successor trustee shall be ANNE S. BANISTER, or if she is unable to serve, or continue serving, as successor trustee, the successor trustee shall be WILLIAM NOEL BANISTER. (C} Resignation of Trustee. Any trustee in office may resign at any time by signing a note of resignation. The resignation must be delivered to the person who is either named in this Declaration of Trust or appointed by the trustee under Paragraph {tV), Part D, to next serve as the trustee. (D) Power to Appoint Successor Trustee. Any trustee shall have the right to appoint, in writing which should be notarized, additional successor trustees to serve in the order nominated if all successor trustees named in this Declaration of Trust cannot serve as trustee. (E) Terminology. As used in this instrument, the term "trustee" shalt include any successor trustee or successor trustees. (F) Bond Waived. No bond shall be required of any trustee. (G) Compensation. No trustee shall receive any compensation for serving as trustee. (H) Liability of Trustee. With respect to the exercise or non-excercise of discretionary powers granted by this Declaration of Trust, the trustee shall not be liable for actions taken in good faith. Such actions shall be binding on all persons interested in the trust property. V. The power to sell or grant options for the sale or exchange of any trust property, including stocks, bonds, debentures and any other form of security or security account, at public or private sale for cash or credit. 4. The power to invest trust property in property of any kind, including but not limited to bonds, debentures, notes, mortgages and stocks. 5. The power to receive additional property from any source and add to any trust created by this Declaration of Trust. 6. The power to employ and pay reasonable fees to accountants, lawyers or investment experts for information relative to thie trust. 7.
