AND NOW, this Zd~ day of April, 2009, upon the recommendation of the Auditor in this
case it is hereby ordered that the Emergency Motion of Morgan, Lewis & Bockius, LLP, to
Quash Subpoenas is hereby denied.
IT IS FURTHER ORDERED that the witnesses subject to the subpoenas shall be
permitted to testify through means of telephonic communications, specifically Mr. Kittredge on
Wednesday Apri122, 2009 at a time determined by the Auditor and Mr. Sonnenfeld on April 23,
2009 at a time determined by the Auditor.
