AND NOW comes Petitioner, John D. McMillen, Jr., with an address of 28
Sheryl Drive, Newville, Lower Mifflin Township, Cumberland County, Pennsylvania
17241, and respectfully represents the following:
1. Under the Pennsylvania Uniform Firearms Act found at Title 18
Pa.C.S. § 6100 et. cet., Petitioner is requesting Restoration of his Right to
Own and Possess a Firearm.
2. On or about May 8, 1972, Petitioner entered the United States
Military whereby he served on Active Duty for approximately two (2) years,
ten (10) months and eight (8) days and received an Honorable Discharge
on or about March 15, 1975. (See copy of Form DD 214 Attached and Marked as
Petitioner's Exhibit "A")
3. Petitioner has a Birth Date of February 13, 1954, and a Social Security
Number of 162-46-9932. (See copy of Form DD 214 as referred to above)
4. On or about June 8, 1977, Petitioner was Sentenced on two (2)
related Theft by Deception Charges in the Butler County Court of
Common Pleas as follows:
a. Docket Number CR 185-of 1977 for the Theft of $1,451.00,
Petitioner received a State Correctional Institution Sentence of not less
than six (6) months nor more than twelve (12) months. Under Title 18
Pa.C.S. § 3921, that conviction was graded as a Misdemeanor of the First
Degree. Furthermore, Petitioner's research appears to confirm this
conviction remains a First Degree Misdemeanor under current
Pennsylvania Law. (See copy of Court Record Certification Attached and
Marked as Petitioner's Exhibit "B")
b. On or about June 8, 1977, Petitioner was also Sentenced at Docket
Number CR 186 of 1977 to a concurrent Sentence for a violation of Title
18 § 3921, then graded as a First Degree Misdemeanor, to undergo
imprisonment in a State Correctional Institution for not less than six (6)
months nor more than twelve (12) months, concurrent to the Sentence
imposed at Docket Number 185 of 1977. (See copy of Court Record
Certification Attached and Marked as Petitioner's Exhibit "C")
5. Petitioner was released after serving his Sentence in full on both of the
above Butler County Court of Common Pleas Docket Numbers on or about
June 7, 1978.
6. To date, Petitioner has had no other involvement with the Criminal Justice
System.
7. Petitioner has gainful employment with Carlisle Syntec and has been so
employed since approximately March 8, 2004.
8. Petitioner had previously been granted a License to Carry a Concealed
Weapon Under Title 18 Pa.C.S. § 6106 by the Butler County Sheriffs
Department from the early 1990's until 2002.
9. Petitioner applied to the Cumberland County Sheriffs Department on or
about May 14, 2008, whereby he was subsequently denied by way of Denial
Letter dated May 14, 2008. (See copy of Denial Letter Attached and Marked as
Petitioner's Exhibit "D")
WHEREFORE, under the Pennsylvania Uniform Firearms Act, it appears that he

since he was released from incarceration.
