WAIVER OF RIGHT TO FILE LIEN - SEPARATE STIPULATION OF
MECHANICS' LIENS
WHEREAS, LION ENTERPRISES INCORPORATED, doing business as BASTIAN
HOMES, party of the first part, hereinafter called "Contractor", has entered into a Construction
Agreement with TROY D. OTTO and ANNE M. OTTO, parties of the second part, hereinafter
called Owners, to provide materials and perform labor necessary for the construction of a single-
family residential structure with accessories thereto upon the premises described as follows:
BEING the premises known as Lot No. 25 as depicted on the Subdivision Plan for
Michaux Meadows, Phase II, recorded in Cumberland County Plan Book 72, Page
5 and further identified as Tax Parcel No. 08-15-0199-061, located on Myerstown
Road, Gardners, Dickinson Township, Cumberland County, Pennsylvania, as more fully
described as Tract No. 2 in Cumberland County Deed Book 224, Page 528 (the
"premises").
NOW THEREFORE, it is stipulated and agreed by and between the said parties, as part
of the Construction Agreement for the consideration therein set forth, that neither the
undersigned Contractor or any sub-contractor or materialman, nor any other person furnishing
labor or materials to said Contractor under the Construction Agreement shall file a lien,
commonly known as a mechanics' lien, for work done or material furnished to said premises or
any part thereof.
This Stipulation is made and intended to be filed with the Prothonotary of Cumberland
County in accordance with the requirements of the laws of the Commonwealth of Pennsylvania.
The undersigned representative of the Contractor confirms that he has the authority on
behalf of the corporation to execute this Stipulation on its behalf.
IN WITNESS WHEREOF, the parties hereto have caused this document to be executed
the 0 0 day of 14P&tl , 2009 intending to thereby legally bind themselves,
their heirs, personal representatives, successors and assigns.
