WHEREAS, GUY D. HUBER and MARIE E. HUBER of 5465 Bonnyrigg Court,
Mechanicsburg, Pennsylvania, is about to execute contemporaneously herewith, a contract, with THOMAS
CONSTRUCTION of 155 Ken-Lin Drive, Carlisle, Pennsylvania, for the erection of a building upon
premises commonly known as 1214 SUMMIT WAY, LOT 7, Township HAMPDEN, CUMBERLAND
County, Pennsylvania, as set forth in th,e deed dated ~-c~ ~,~, c~ 1 20c~'-I , recorded at Deed Book
Q (o t , Page O.c~ ) ~ , in the Recorder s Office for CUMBERUAND County, Pennsylvania, as more
specifically described in Exhibit "A" which is incoq0orated herein and attached hereto.
NOW, April 29, 2004, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being expressly
waived.

ALL THAT CERTAIN tract or parcel of land being situate in Township of Hampden,
County of Cumberland, and Commonwealth of Pennsylvania, more particularly bounded and
described as follows:
BEGINNING at a point on the southeR fight of way line of Summit Way, that is located
at the northwester corer of Lot No. 6 being the northeaster corer of Lot No. 7; thence along
Lot No. 6 South 00 degrees 48 minutes 16 seconds East, by a distance of 226.93 feet to a point;
thence along the lands now or formerly of Donald L. Basehore South 89 degrees 11 minutes 44
seconds West by a distance of 108 feet to a point; thence along Lot No. 8 North 00 degrees 48
minutes 16 seconds West by a distance of 240.29 feet to a point on the southern right of way line
of Summit Way; thence along the southeR right of way of Summit Way on a curve to the right
with a radius of 375 feet with an arc length of 109.21 feet having a chord with a distance of
108.82 feet and a chord beating South 83 degrees 45 minutes 20 seconds East to a point; the
place of BEGINNING.
BEING Lot #7 Plan of Harapden Summit, Phase 1, recorded in Plan Book 87, Page 79.
CONTAINING 25,518 square feet or 0.59 acres of land.
