THIS AGREEMENT made the 7th day of May, 2004, by and between HOFFMAN'S
CUSTOM CONTRACTING, INC., a Pennsylvania corporation, hereinafter referred to as Contractor,
and TIMOTHY D. HOFFMAN, married man, hereinafter referred to as Owner, whereby the former
undertook and agreed to erect and construct a custom built home on that certain lot of ground situate
at Lot 1, Kings Gap Estates, Dickinson Township, Cumberland County, Pennsylvania, known as
more fully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

Timothy D. Hoffman, married man, known to me to be the person whose name is subscr/bed to the
within instrument, and who acknowledge himself to be the Owner of Lot 1, Kings Gap Estates,
Carlisle, Pennsylvania and that he as such owner, executed the foregoing statement for the purposes
therein contained by signing his name.

LEGAL DESCRIPTION
ALL THAT CERTAIN lot of land situate in Dickinson Township Cumberland County Pennsylvania,
bounded and described in accordance with Final Subdivision Plan of Kings Gap Estates recorded
on April 10, 1992, in the hereinafter named Recorder's Office in Plan Book 64, Page 48, etc., as
follows:
BEGINNING at a point on the western line of 60 feet wide Chelsea Lane at the northeastern comer
of Lot No. 1 on the above mentioned Final Subdivision Plan of King's Gap Estates; thence from said
point at the place of beginning along said western line of 60 feet wide Chelsea Lane, South 15
degrees 20 minutes 21 seconds East a distance of 150.00 feet to a point; at the dividing line between
Lots Nos. 1 and 14; thence along said dividing line between said Lots Nos. 1 and 14, South 74
degrees 39 minutes 39 seconds West a distance of 354.23 feet to a point in line of land now or
formerly of Charles D. Smith; thence along line of said land now or formerly of Charles D. Smith,
North 11 degrees 34 minutes 28 seconds West, a distance of 150.32 feet to a concrete monument;
thence along line of land shown on Plan of Lots recorded in the hereinafter named Reeorder's Office,
in Plan Book 54, at Page 4, North 74 degrees 39 minutes 39 seconds East, a distance of 344.36 feet
to a point on the western line of 60 feet wide Chelsea Lane at the Place of BEGINNING.
THE ABOVE described Lot of land is all of Lot No. 1 as shown on said Final Subdivision Plan of
Kings Gap Estates recorded as aforesaid, and contains an area of 52,395 square feet, more or less,
or 1.20 acres, more or less.
THE ABOVE described lot of land has a mailing address of 7 Chelsea Lane, Carlisle, PA 17013.
