GARDNER, : Owners : VS, : : NORMAN ELAM, : Contractor : IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA Number~q-,lC~O Term, 2004 WHEREAS, ROBERT C. GARDNER and JESSICA L. GARDNER, his wife, (collectively "Owner"), of Cumberland County, Pennsylvania, are about to execute contemporaneously herewith, a contract, with NORMAN ELAM {"Contractor"), of Cumberland County, Pennsylvania, forthe erection of a building upon a lot of land situate, lying and being in Lower Allen Township, Cumberland County, Pennsylvania, bounded and limited in accordance with Exhibit "A" attached hereto; NOW, THEREFORE, on April 30, 2004, at the time of and immediately before the execution of the principal contract, and before anyauthority has been given by the said 0wnor to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One (81.00) Dollar, to Contractor paid by Owner, it is agreed that no lien shall be filed against the building and/or land by the contractor, or any subcontractor, nor by any ofthe material men or workmen or any other person for anylabor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. WITNESS our hands and seals the day and year aforesaid. WITNESS: ROBERT C. GARDNER ALL THAT CERTAIN piece or pamel of land situate in Lower Allen Township, Cumberland County, Pennsyvlania, bounded and described as follows, to wit: BEGINNING at a point in the center line of a public mad known as the Rossmoyne Road (L.R. 21069), said point being at the corner of other lands formerly of Clarence G. Stoner and Blanche V. Stoner, his wife; thence continuing along the center line of said Rossmoyne Road (L.R. 21069), South 42 degrees 14 minutes East one hundred fifty and zero hundredths (150.00) feet to a point; thence South 62 degrees 03 minutes West two hundred seventeen and forty-five one-hundredths (217.45) feet to a point; thence North 36 degrees 57 minutes West one hundred forty-seven and sixteen one-hundredths (147.16) feet to a point; thence North 62 degrees 03 minutes West two hundred three and forty-three one-hundredths (203.43) feet to a point in the center line of Rossmoyne Road (L.R. 21069), the place of BEGINNING. CONTAINING 32,550 square feet as depicted on the Subdivision Plan of Clarence G. and Blanche V. Stoner, said Plan being dated August 13, 1971 and recorded in the Cumberland County Recorder of Deeds Office on November 11, 1971 in Plan Book 22, Page 129.
