THIS AGREEMENT made the 7th day of May, 2004, by and between Lawmen Construction,
LLC hereinafter referred to as Contractor, and Keith W. Sheriff and Barbara A. Sheriff, hereinafter
referred to as Owners, xvhereby the former undertook and agreed to erect and construct a custom
built home on that certain lot of ground situate at Lot 8 Deerview Drive, Newville, Upper Frankford
Township, Cumberland County, Pennsylvania, known as more fully described in Exhibit "A"
attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the fight to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

of Lot 8 Deerview Drive, Newville, Pennsylvania and that they as such owners, executed the
foregoing statement for the purposes therein contained by signing their names.

The land referred to in this Commitment is described as follows:
ALL THAT CERTAIN tract of land situate in Upper Frankford Township, Cumberland County,
Pennsylvania, bounded and described in accordance with a subdivision plan prepared by Eric
Diffenbaugh, RPLS dated June 30, 2003 and recorded in the Office of the Recorder of Deeds for
Cumberland County in Plan Book,88 Page 79 as follows:
BEGINNING at a point in western edge of Deerview Drive at corner of Lot No. lB on said plan; thence
along Lot No. lB and Lot No, 1, North 53 degrees 34 minutes 26 seconds East 212,74 feet to an iron pin
set; thence along Lot No. 15, South 43 degrees 09 minutes 49 seconds East 216.53 feet to an iron pin
set; thence along Lot No. 7 on plan South 45 degrees 48 minutes 22 seconds West 206.90 feet to a
point in western edge of Deerview Drive; thence along western edge of Deerview Drive, North 44
degrees 11 minutes 38 seconds West 245,25 feet to an iron pin set, the Place of BEGINNING.
CONTAINING 1.1075 acres and designated as Lot No. 8 of Brick Church Estates.
BEING part of the same premises which Bryant G. Minnich and Donna K. Minnich, his wife, granted and
conveyed to Bryant G. Minnich and Timothy B. Minnich by deed dated May 5, 1997 and recorded in the
Office of the Recorder of Deeds for Cumberland County in Deed Book 157, Page 183
