Whereas, J. W. Mumper, Prcsidcnt, of 6 Lynchburg Court,
Mechanicsburg, PA, Cumberland County, Pennsylvania is about to
execute contemporaneously herewith, a contract, with
David F. Ratkaj and Christine M. Hummel Ratkaj, of
Cumberland County, Pennsylvania, for the construction of a two
story contemporary home.

NOW, M~v4, , 2004, at the time of and immediately
before the execution of the principal contract, and before any
authority has been given by the said OWNER to the said CONTRACTOR
to commence work on the said building, or purchase materials for
the same in consideration of the making of the said contract with
OWNER and the further consideration of One Dollar, to CONTRACTOR
paid by OWNER it is agreed that no lien shall be filed against the
building by the contractor, or any sub-contractor, nor by any of
the material men or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being
expressly waived.

ALL THAT CERTAIN piece, parcel or lot of lands situate in
East Pennsboro Township, Cumberland County, Pennsylvania,
designated as Lot 44 of River Bend-A Planned Community and being
further bound and described as follows to wit:
BEGINNING at a point on the southern right of way line of
Halyard Way at the Southwest corner of Lot No. 43 of River Bend,
as recorded in Plan Book 65, Page 123; thence said lot and along
lot No. 33 of RiverBend, South 40 degrees 25 minutes 45 seconds
East, a distance of 139.29 feet to a point; thence continuing
along Lot No. 33, the following four (4) courses:
1. South 46 degrees 40 minutes 16 seconds West, a distance
of 148.30 feet to a point;
2[ North 48 degrees 48 minutes 00 seconds West, a distance
of 56.84 feet to a point;
3. South 75 degrees 23 minutes 12 seconds West, a distance
of 63.99 feet to a point;
4. South 14 degrees 36 minutes 48 seconds East, a distance
of 74.99 feet to a point on the Northern right of way line of
Belle Vista Drive;
THENCE along said right of way line South 75 degrees 23
minutes 12 seconds west, a distance of 137.78 feet to a point on
the Southern right of way line of Halyard Way; thence along said
right of way line of Halyard Way the following five (5) courses:
1. By a line curving to the right having a radius of 225~00
feet, an arc length of 6.35 feet, and a chord bearing of North 02
degrees 40 minutes 50 seconds, West, a distance of 6.35 feet to a
point;
2. South 88 degrees 07 minutes 41 seconds West, a distance
of 5.00 feet to a point;
3. By a line curving to the right having a radius of 230.00
feet, an arc length of 245.30 feet, and a chord bearing of 28
degrees 40 minutes 54 seconds East, a distance of 233.84 feet to a
point;
4. North 59 degrees 14 minutes 07 seconds East, a distance
of 99.93 feet to a point;
5. By a line curving to the left having a radius of 320.00
feet, an arc length of 53.98 feet, and a chord bearing North 54
degrees 24 minutes 11 seconds East, a distance of 53.91 feet to a
point, the Place of Beginning.
CONTAINING 1.01 acres and being Lot No. 44, as shown on the
Final Plan for Lot No. 44 and Lot No. 33 of RiverBend, prepared by
Rettew Associates, dated July 13, 2001. Said Plan to be recorded
in the Office of the Recorder of Deeds in and for Cumberland
County.
BEING the same premises which River Bend Management Limited
Partnership, by their deed dated August 22, 2001, and recorded in
the Cumberland County Recorder of Deeds office, in Book 248, Page
189~ have granted and conveyed to David F. Ratkaj and Christine M.
Hummel, now known as Christine M. Hummel Ratkaj, his wife,
