AND NOW, this 23rd day of April, 2009, upon consideration of the PETITION FOR CITATION
TO COMPEL PRODUCTION OF FIRST CODICIL TO THE LAST WILL AND TESTAMENT OF
JOSEPH S. LOTZ, DATED MAY 10, 2002 PURSUANT TO 20 PA. C.S. §3137 TO THE REGISTER
OF WILLS OF CUMBERLAND COUNTY, PENNSYLVANIA, the Register of Wills finds the
following with regard to the Estate of Joseph Samuel Lotz and renders the following decision:
In that seven months have passed since the date of the original Decree of Probate and the filing of
this Petition for Citation to Compel, the time within which the Register of Wills may open the probate
record and admit a later codicil has lapsed.
ACCORDINGLY IT IS HEREBY DECREED that the aforementioned Petition to
Compel is dismissed as time barred, pursuant to the PEF Code, Sections 908 and 3133.
