Erie is subrogated to its insured, ERIE Insurance, in connection with a loss that occurred on July 10, 2007, which is the incident giving rise to this matter. 3. Pursuant to the Soldiers and Sailors Civil Relief Act of 1940, as modified by the Servicemembers Civil Relief Act of 2003, this affidavit is submitted as proof that Linsay Klinger is not presently in active service in any branch of the United States Military. 4. As proof of the military/non-military status of Linsay Klinger, the undersigned contacted the Defense Manpower Data Center which provided written verification of such status, attached hereto as Exhibit A.
