RISSER, by and through his cg4tinsel, WILLIAM J. HABERSTROH, ESQUIRE and CHARLES E. SHIELDS, III, ESQUIRE, and files this Petition for Settlement of a Small Estate, under and pursuant to the provisions of Section 3102 of the Probate Estates and Fiduciaries Code and, in support thereof, avers as follows: 1. That your Petitioner, STANLEY S. RISSER, is a competent adult currently residing at 528 Fairvalley Road, Martinsburg, Blair County, Pennsylvania, and is the son of the above- captioned decedent. 2. That the said JEAN MARCH RISSER, A/K/A JEAN M. RISSER died a widow on the 19~ day of November, 2008, and at that time, was a resident at Messiah Village, 606 West Keller Street, Mechanicsburg, Cumberland County, Pennsylvania. That the said decedent died testate, a copy of said Will is attached and marked as Exhibit "A". 3. The said Charles E. Risser died the 22nd day of May, 1994 thereby leaving your Petitioner as the sole heir and beneficiary. 4. That the only Probate Asset of the decedent at the time of her death was a Checking Account on Deposit with Sovereign Bank, having a balance of $4,226.54. A copy of the said Statement of the Account is attached hereto, made a part hereof and marked as Exhibit "B". 5. Additionally, the sum of $8,692.00 was refunded by the United States Treasury, as a refund on the decedent's 2008 Final Life Tax Return. 6. That the total assets available to the decedent are $12,918.54. 7. That your Petitioner has advanced the payment of the following expenses, which rightfully should be deducted from the aforesaid amount, to wit: (a) $72.97 -Alert Pharmacy -Final Pharmacy Bill; (b) $1.82 - Verizon -Final Phone Bill; (c) $374.22 -Register of Wills, Agent -Inheritance Tax; (d) $15.00 -Register of Wills -Fee to File Inheritance Tax Return; (e) $20.00 -Clerk of Orphans' Court -Fee to file this Petition and Certified Copy of Final Order. 8. That the following expenses are unpaid and will be paid upon receipt of the funds in the account of the decedent as set forth herein, to wit: (a) $1,000.00 -William J. Haberstroh, Esquire -Legal Services in connection with filing this Petition; (b) $10.00 -William J. Haberstroh, Esquire -Administrative Postage; (c) $4,495.80 -Messiah Village, Mechanicsburg, Pennsylvania -Final Nursing Home Bill 9. It has been determined that the decedent did not receive any type of assistance from the Commonwealth of Pennsylvania, Department of Public Welfare. A copy of the letter evidencing this fact is attached hereto and made a part hereof and marked as Exhibit "C". 10. All claims, indebtedness, taxes and obligations of the decedent have been paid and satisfied in full except for those set forth in Paragraph 8 above. Therefore, your Petitioner is entitled to all assets of the estate. WHEREFORE, your Petitioner respectfully prays that an Order be entered authorizing and directing the said Sovereign Bank to pay over unto the Petitioner the balance on deposit with their institution as to Account No. 571120636 as Petitioner is entitled as sole heir.
