surviving spouse is three (3) percent [72 P.S. §9116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is zero
(0) percent [72 P.S. §9116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements
for disclosure of assets and filing a tax return are still applicable even if the surviving spouse is the only beneficiary.

The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a

The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is four and one-half (4.5) percent,
except as noted in 72 P.S. §9116 1.2) [72 P.S. §9116 (a) (1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 P.S. §9116 (a) (1.3)]. A
sibling is defined under Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

NOTE: the property was in a state of deterioration at the date of death. Mrs. Young was
advanced in years and had not maintained the property. She had allowed other people to reside
in the house with her who had not maintained it. As a result, the house suffered from termite
infestation, mold, and other serious problems beyond being in a state of general deterioration.
The value listed here is based upon an offer to purchase the home received by the executrix.
To date, however, the executrix has not been able to settle on the sale of the property because
Countrywide Home Mortgage, who holds the mortgage against it, has not yet approved a sale of
a property that will not generate sufficient proceeds, after the payment of the costs of sale, to
satisfy the mortgage in full.

STATEMENT OF EXPLANATION
File No. 21-08-00168
For several years prior to Margaret B. Young's death, she lived in the property at 809 Flintlock
Ridge Road with her granddaughter, Joanne L. Bodley, and her granddaughter's husband,
Francisco Cesar Torres. During that time, Ms. Bodley and Mr. Torres obtained control of
Margaret Young's finances. As a result, they diverted her retirement income for their own
purposes and failed to make payment on the mortgage which encumbered the property, the
electric utility bills, and other utility bills. As a result of that, at the time of Margaret Young's
death, her mortgage had not been paid for approximately one year and was in foreclosure, her
electric bills had not been paid for approximately a year, and various other utility accounts were
unpaid.
During the final several years of Margaret B. Young's house, while the house was occupied with
her by her granddaughter and her granddaughter's husband, the house fell into an extreme state
of deterioration. The property was not maintained, damage was done to the interior of the
:property, including walls, ceilings, and floors, and the house was generally allowed to
deteriorate. As a result of that, following the death of Margaret B. Young, the executrix has been
unable to successfully market or sell the property for enough money to pay the first mortgage
against it, which is owed to Countrywide Home Mortgage Co.
'The will appointed both Mrs. Young's daughter, Virginia Conklin (formerly Virginia Enders),
and her granddaughter, Joanne Bodley, co-executrices of the will. As a result of that, Joanne
Bodley was able to control the administration of the estate for the first six months following the
date of death and declined to move out of the property or to pay any of its expenses. As a result,
Virginia Conklin had to retain separate counsel to remove Joanne Bodley as a personal
representative and to force Joanne Bodley and Francisco Cesar Torres to vacate the property. By
the time that was done, the property was in an even more advanced state of disrepair and
deterioration.
Virginia Conklin has marketed the property and attempted to sell it. Because of its advanced
state of disrepair and deterioration, those efforts have had very limited success. She has received
an offer to sell the property for $158,500.00, but has not been able to persuade Countrywide
Home Mortgage Co., which is in a state of receivership itself, to accept less than the full amount
i.t is owed on the mortgage. As a result, it is anticipated that the property maybe lost at
foreclosure in the near future.

I, MARGARET B. YOUNG, of Lower Allen Township, Cumberland County,
Pennsylvania, declare this to be my last will and revoke any will previously made by me.
ITEM I. I direct that all my just debts and funeral expenses, including my
gravemarker and all expenses of my last illness, and any and all taxes and assessments
imposed by any governmental body as a result of my death, whether on property passing
under this will or otherwise, shall be paid from my residuary estate as soon as practicable
after my decease as a part of the expense of the administration of my estate.
ITEM II. I give and bequeath to my granddaughter, JOANNE L. BODLEY, the
fallowing items, provided she survive my death by thirty (30) days:
A. My cuckoo clock from Germany and my Belleeck china clock.
B. My late husband's electric trains and train accessories and the
cabinets in which they are generally kept.
C. My pictures from Germany.
Should the said Joanne L. Bodley predecease me or fail to survive my death by thirty (30)
days, I give and bequeath these items to my daughter, VIRGINIA L. ENDERS.
ITEM III. {give and bequeath to my daughter, VIRGINIA L. ENDERS, the following
items, provided she survive my death by thirty (30) days:
A. My grandfather clock.
B. My two antique mantle clocks.
C. My marbletop oval table.
D. The Currier & Ives "Little Dollie" print.
E. The corner cupboard and sideboard which belonged to my uncle.
Should the said Virginia L. Enders predecease me or fail to survive my death by thirty (30)
" days, I give and bequeath these items to my granddaughter, JOANNE L. BODLEY.

ITEM IV. I give, devise, and bequeath all the rest, residue, and remainder of my
possessions and estate of every nature and wherever situate in equal shares to my
daughter, VIRGINIA L. ENDERS, and my granddaughter, JOANNE L. BODLEY, provided
each survives my death by thirty (30) days. In the event that either of them predeceases
me or is deceased on the thirty-first day following my death, then 1 give their share
hereunder to the other of them.
ITEM V. I appoint my daughter, VIRGINIA L. ENDERS, and my granddaughter,
JOANNE L. BODLEY, or the survivor of them, co-executrixes of this my last will.
ITEM VI. i direct that my personal representatives and fiduciaries shall not be
required to give bond for the faithful performance of their duties in any jurisdiction.

understand that it takes time to get insurance's processed and other estate matters taken care of,
however, our terms are normally cash at time of service and we offered the courtesy of 30 day billing
