WHEREAS, Barry L. Myers and Margaret S. Myers of Newville,
Pennsylvania (herein "Owner") have entered into a contract, with Oide Forge Builders,
Inc. of Mechanicsburg, Pennsylvania (herein "Contractor"), for the erection of a
dwelling upon property known as Lot 52, North Newton Hills (a/k/a 7 Camelot Lane),
Township of North Newton, Cumberland County, Pennsylvania, more particularly
described in Exhibit "A" attached hereto.
NOW, MQJ4 1 -*'0- , 2009, at the time of and immediately
before construction pursuan to such principal contract, and before any authority has
been given by the said Owner to the said Contractor to commence development or
purchase materials for the same in consideration of the making of the said contract with
Owner, and the further consideration of One ($1.00) Dollar in hand paid to Contractor
by Owner, it is agreed that no lien shall be filed against the building by the Contractor,
or any sub-contractor, nor by any of the material-men or workmen or any other person
for any labor, or materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.

EXHIBIT "A"
ALL THAT CERTAIN tract of land lying and being situate in North Newton
Township, Cumberland County and Commonwealth of Pennsylvania more particularly
described as follows to wit:
BEGINNING at a point on the northern right of way line of Camelot Lane
(50 feet wide) and being on the dividing line between Lot No. 51 and Lot No. 52 on the
hereinafter referenced subdivision plan; thence along the dividing line between Lot No.
51 and Lot No. 52 North 24 degrees 01 minute 53 seconds West for a distance of
129.01 feet to a point on lands now or formerly of Greg R. and Mary H. and Mary H.
Shade; thence along lands now or formerly of Greg R. and Mary H. Shade North 66
degrees 15 minutes 53 seconds East for a distance of 115.87 feet to a point on the
dividing line between Lot No. 53 and Lot No. 52; thence along the dividing line between
Lot No. 53 and Lot No. 52 South 14 degrees 35 minutes 41 seconds East for a distance
of 142.64 feet to a point on the northern right of way line of Camelot Lane; thence along
Camelot Lane South 75 degrees 24 minutes 19 seconds West to a point; thence
continuing along Camelot Lane on a curve having a radius of 225.00 feet, an arc length
of 37.06 feet and a chord bearing of South 70 degrees 41 minutes 13 seconds West for
a distance of 37.06 feet to a point on the dividing line between Lot No. 51 and Lot No.
52, the point and place of BEGINNING.
BEING Lot No. 52 on the Final Subdivision Plan for North Newton Hills,
Phase III, dated March 2, 2005 and recorded April 12, 2006 in the Cumberland County
Office for the Recorder of Deeds in Plan Book 92, Page 49.
UNDER AND SUBJECT to the Declaration of Covenants and Restrictions
for North Newton Hills, Phase III as recorded in Miscellaneous Book 729, Page 437.
BEING PART OF THE SAME PREMISES which James C. Costopoulos,
et al, by their deed dated November 16, 2004 and recorded February 17, 2005 in the
Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Deed
Book 267, Page 2857 granted and conveyed unto Olde Forge Builders-Newville, Inc., in
fee.
