CIVIL ACTION - COMPLAINT TO QUIET TITLE NOW COMES Plaintiff, Deutsche Bank National Trust Company As Trustee Under The Pooling and Servicing Agreement Series ITF RAST 2006-A3, by and through its undersigned attorneys, and files this Complaint, averring in support thereof as follows: PARTIES 1. Plaintiff is Deutsche Bank National Trust Company As Trustee Under The Pooling and Servicing Agreement Series ITF RAST 2006-A3 (hereinafter "Deutsche Bank"), which maintains an address at 460 Sierra Madre Villa Avenue, Suite 101, Pasadena, CA 91107 2. Defendant, Jeannie B. Mohmand, is an adult individual believed to residing at 4020 Lisburn Road, Mechanicsburg, PA 17055. 3. Defendant, Joshua Kesler, is an adult individual believed to the record owner of and residing at 245 North 25th Street, Camp Hill, PA 17011. STATEMENT OF FACTS 4. On or about October 26, 2005, Jeannie B. Mohmand borrowed $292,000.00 from Lancaster Mortgage Bankers in order to complete the purchase of the property located at 245 North 25th Street, Camp Hill, PA 17011 (hereinafter "Property"). 5. As security for the Lancaster Mortgage Bankers loan and as a material condition thereof, Jeannine B. Mohmand executed a mortgage (hereinafter "Mortgage") and promissory note on the Property. A true and correct copy of the Mortgage is attached hereto, incorporated herein, and marked as Exhibit "A". 6. The Mortgage was recorded with the Recorder of Deeds for Cumberland County on November 1, 2005 at Mortgage Book No. 1929, Page No. 916. 7. On October 26, 2005, Lancaster Mortgage Bankers executed an Assignment of Mortgage to Mortgage Electronic Registration Systems, Inc. (hereinafter "the Assignment"). The Assignment of Mortgage was signed by Darlene Pereira, Vice President of Lancaster 2 Mortgage Bankers, and notarized by Rebecca M. Gonzalez, a Notary Public of New Jersey. A true and correct copy of the Assignment of Mortgage is attached hereto, incorporated herein, and marked as Exhibit "B". 8. Upon review of the public record, Plaintiff believes and therefore avers that the Assignment was inadvertently never recorded with the Recorder of Deeds of Cumberland County. Further, Plaintiff has been unable to locate the originally executed Assignment, although a copy of same has been located. See Exhibit "B". 9. In accordance with the applicable law and after acquisition of the Mortgage and Note, on November 1, 2006, Plaintiff initiated foreclosure proceedings against the Defendant, Jeannie B. Mohmand in the Court of Common Pleas for Cumberland County at No. 06-6376 (hereinafter "Foreclosure Action"). A true and correct copy of the Complaint in Mortgage Foreclosure is attached hereto, incorporated herein, and marked as Exhibit "C". 10. Plaintiff obtained a default judgment in its Foreclosure Action on December 27, 2006 in the amount of $308,691.96. A true and correct copy of the Default Judgment is attached hereto, incorporated herein, and marked as Exhibit "D". 11. Subsequent to initiating its Complaint in Mortgage Foreclosure and prior to any Sheriff Sale, Plaintiff filed an Affidavit of Lost Assignment of Mortgage with the Recorder of Deeds for Cumberland County on July 5, 2007, which was accepted and logged at Book No. 0738, Page No. 1543. A true and correct copy of the Affidavit of Lost Assignment of Mortgage is attached hereto, incorporated herein, and marked as Exhibit "E". 12. Prior to execution upon Plaintiff's judgment, Defendant, Jeannie B. Mohmand, conveyed the Property subject to the Lancaster Mortgage Bankers Mortgage, the Complaint in Mortgage Foreclosure, and the judgment to Defendant, Joshua Kesler for $10,000.00. A true and correct copy of the Deed is attached hereto, incorporated herein, and marked as Exhibit 'F', 13. Upon information and belief and at all times relevant hereto, Defendant Kesler knew or should have known that the Property was subject to Plaintiff's Mortgage in the amount of $292,000.00 and that his purchase was subject to the Mortgage and pending Foreclosure Action. 14. Prior to the scheduled Sheriff Sale of the Property, Defendant Kesler interjected himself into the Foreclosure Action and argued that Plaintiff's title to the Mortgage was incomplete, and therefore it could not move forward with its Foreclosure Action. 15. Plaintiff stayed the Scheduled Sheriff Sale by agreement with Defendant Kesler and immediately commenced a review of its loan documents and file concerning the Lancaster Mortgage Bankers Mortgage. 16. Upon further review of its file and after a diligent search, Plaintiff located a copy of Assignment of Mortgage from Lancaster Mortgage Bankers to Mortgage Electronic Registration Systems, Inc., but could not locate the original of said document. 17. Plaintiff now seeks to supplement the existing public records with the newly discovered Assignment. COUNT I - ACTION TO QUIET TITLE Deutsche Bank v. Jeannie B. Mohmand and Joshua Kesler 18. Plaintiff incorporates by reference Paragraphs one (1) through seventeen (17) of its Complaint as if fully set forth herein. 19. Rule 1066 of the Pennsylvania Rules of Civil Procedure provides this Honorable Court with broad discretion to, inter alia: 4 (13)(1). "order that the defendant be forever barred from asserting any right, lien, title or interest in ... land inconsistent with the interest or claim of the plaintiff set forth in the complaint"; (B)(2). "enter a final judgment that a document, obligation or deed affecting a right, lien, title or interest in. . . land is cancelled or is valid, invalid or discharged"; (B)(3). "order[] the defendant, the prothonotary, or the recorder of deeds to file, record, cancel, surrender or satisfy of record ... any plan, document, obligation or deed determined to be valid, invalid, satisfied or discharged, and to execute and deliver any document, obligation or deed necessary to make the order effective"; and (13)(4). "enter any other order necessary for the granting of proper relief." Pa. R. Civ. P. 1066(b)(1)-(4). 20. Defendant Jeannie B. Mohmand executed the Lancaster Mortgage Bankers Mortgage, which has been recorded with the Recorder of Deeds for Cumberland County. 21. The Mortgage was subsequently transferred to Mortgage Electronic Registrations Systems, Inc. by virtue of the executed and notarized Assignment of Mortgage. 22. The Assignment of Mortgage, through no fault of the Plaintiff, has not been recorded, although a Lost Assignment Affidavit has been recorded. 23. Plaintiff seeks to supplement the existing record by recording a copy of the Assignment of Mortgage. 24. Plaintiff is without adequate remedy at law and will suffer irreparable harm unless the requested relief is granted. WHEREFORE, in accordance with Pa. R. Civ. No assignment of mortgage is recorded in the Recorder's Office assigning Lancaster Mortgage Bankers' mortgagee rights to Plaintiff. 7. The only copy of an assignment presented by Plaintiff as an exhibit in its Quiet Title Complaint does not assign Lancaster Mortgage Bankers' rights to Plaintiff. In fact, the assignee information is blank on the assignment. 8. Plaintiff is not an assignee of any mortgagee interest, and as such cannot avail itself of any of the rights, such as foreclosure, attributable to a mortgagee. 9. Plaintiff has no title interest in this property according the public records contained in the Cumberland County Recorder of Deeds office and as such, Plaintiff has no capacity to sue in foreclosure or to quiet title under some presumption that it is a mortgagee.
