CIVIL ACTION - LAW
COMPLAINT
1. The Plaintiff is an adult individual residing at 1122 Blair Street, Portage,
Pennsylvania 15946.
2. The Defendant is a corporation having its principal offices located at 46
South Hunter Highway, Drums, Pennsylvania 18222.
3. The facts and occurrences hereinafter related took place on or about July
17, 2007, on South Hanover Street in the Borough Carlisle, Cumberland County,
Pennsylvania.
4. At the time and place aforesaid, Plaintiff was the operator of a 2007 PT
Cruiser and was in the right hand northbound lane of South Hanover Street.
5. At the time and place aforesaid, Defendant was the owner of a tractor
trailer being operated by its agent, servant or employee in the left hand northbound lane
on South Hanover Street.
6. At all times relevant hereto, the Defendant's tractor trailer was being
operated by Galen Darr, an employee of the Defendant who was acting in the scope of
his employment.
7. As Plaintiff was in the right hand northbound lane of South Hanover
Street, the Defendant's driver, Galen Darr, moved the tractor trailer into the side of the
vehicle being operated by the Plaintiff and causing the damages hereinafter set forth.
8. The aforesaid accident and damages resulting therefrom were due to the
negligence of Defendant's driver in that he:
a) failed to keep a proper lookout for other vehicles;
b) failed to yield the right-of-way to Plaintiffs vehicle;
c) changed lanes without seeing that it was safe to do so; and
d) failed to maintain his vehicle within the marked lane of travel.
9. Solely as a result of Defendant's negligence, the vehicle operated by
Plaintiff sustained damages totaling ONE THOUSAND FOUR HUNDRED SIXTY and
51/100 ($1,460.51) DOLLARS.
WHEREFORE, Plaintiff demands judgment against the Defendant in an amount
not in excess of mandatory arbitration limits.
