PETITION FOR AN ORDER FOR
SETTLEMENT OF A SMALL ESTATE

Comes now, the undersigned Executor of the Estate of Thomas E. O'Donnell, Jr.,
deceased (the "T. O'Donnell Estate"), and makes this Petition for an Order from this
Court authorizing the Executor to settle and administer the T. O'Donnell Estate as a
Small Estate pursuant to Section 3102 of the PEF and Rule 6.11-2 of the Local Rules of
this Court. In support of this petition, the Executor of the T. O'Donnell Estate avers and
states that: (1) the total value of the personal property in the T. O'Donnell Estate does not
equal or exceed $25,000 in value; and (2) the deceased owned no real property in
Pennsylvania, or elsewhere, at the time of his death.
A list of the estimated assets and liabilities in the T. O'Donnell Estate, and a list
of the names and addresses of the beneficiaries under the deceased's Last Will and
Testament, are provided below:

The Executor makes this petition to settle the T. O'Donnell Estate as a Small
Estate in order to: (1) simplify and expedite the administration of T. O'Donnell's estate;
and (2) minimize the costs of administering the T. O'Donnell Estate in the best interests
of the deceased's above beneficiaries. Accordingly, the Executor requests dismissal of
the formal proceeding [Estate of Thomas E. O'Donnell, Jr., File No. 2008-00648; PA File
No. 21-08-0648] in light of this Petition to proceed as a Small Estate.
In view of the foregoing, the Executor requests this Court to enter the proposed
"Order Granting Petition for Settlement of a Small Estate" which is enclosed herewith.
