Appellant, beneficiary of the estate, has filed a notice of appeal
from the January 8, 2009 order denying the motion to disqualify
counsel for the Estate and the Trusts.
In a decedent's estate, the final appealable order generally is the
confirmation of the personal representative's final account. Estate of
Borkowski, 794 A.2d 388 (Pa. Super. 2002). A trial court's order
regarding disqualification of counsel in a civil case is interlocutory and
not immediately appealable. See Vaccone v. Syken, 899 A.2d 1103
(Pa. 2006); Karch v. Karch, 879 A.2d 1272 (Pa. Super. 2005); In re
L.1., 691 A.2d 520 (Pa. Super. 1997), appeal denied, 699 A.2d 735
(Pa. 1997); see also Pa.R.A.P. 34i(b)(1) (a final order is any order
that disposes of all .claims and all parties).
Accordingly, the above-captioned appeal is hereby QUASHED as
having been taken from an order that is interlocutory and not
appealable.
