Castagneto do hereby Petition the Court to provide a Court Order of ownership to myself for the 2001 Saturn, VIN #1 G8JU52F81Y533329, that I purchased on May 26, 2008 from Family Pre-Owned Auto of 6350 Baltimore Avenue, Fernwood PA, 19050. Described below, in chronological order, are the steps that have been taken related to the vehicle purchase, Penn Dot transactions, and attempts to contsict all related parties in order to obtain the title. 1. On 5/26/08 1 purchased the above vehicle from Family Pre-Owned Auto. My purchase receipt indicates that I paid for the vehicle, a 6 month warranty, state sales tax, title and registration (exhibit 1). 2. On same date, temporary registration tags were provided to me by the dealership (exhibit 2). 3. On or about August 11, 2008, my spouse and I contacted Penn Dot, who indicated they had not received the paperwork, nor taxes, from the dealership. 4. On or about, August 11, 2008, my spouse and I began calling the dealership, each individually, daily. I was able to leave a voice message during the first week, but thereafter, no one answered the phone and the message machine stated that it was full (Exhibit 3). 5. On 8/25/08, 1 faxed the dealership with an urgent request and prior statements as to my attempts to contact them via phone (exhibit 3). This was followed by a fax failure notice (exhibit 4). 6. On 8/28/09, Penn Dot granted another temporary vehicle registration tag (exhibit 5). 7. On 8/29/08, 1 received a complaint form packet from the Attorney General's office, based on my 8/25/08 phone call to them, requesting such (exhibit 6). 8. On October 7, 2009, 1 filed a claim with the Attorney General's office, as still no response from the dealership had been acquired by myself nor Penn Dot (exhibit 7). 9. A letter dated 10/21/09 want sent to me from Penn Dot requesting that I Petition the Court of Common Pleas in my jurisdiction in order for them to issue a Certificate of Title. This was received on 10/25/08 (exhibit 8). 10. 1 received a letter from the Attorney General's Office, dated 10/30/08, with a file number assignett, B-009376-2008 (Exhibit 9). 11. 1 received a letter did 11/6/08 from the same office stating that I had not provided the address for the dealership on the original complaint. On 11/13/08, 1 called the same office and left a voicemail with the address again. I called them on 11/29/08 and I called on 12/1/08 and left a message. When they returned my caul, they indicated that Family Pre-Owned Auto had roomed, t that they were able to find them, and would handle the matter (Exhibit 10). 12. Following the receipt of the Penn Dot 10/21/08 letter, I contacted the office of Kathy Mumma on 11 /7108, and on 11 /17/08, and left a message; as I did not understand what needed to be done regarding the letter. On 11/14/09, 1 received a form from Penn Dot to "Request Vehicle Information" ; as I would not be able to comply with the letter to Petition the Cumberland County Court without having knowledge of the prior owner of the vehicle. Such was filed with Penn Dot on 11/14/08 for $5.00 (Exhibit 11). Information on prior owner was received on 12/6/09 (Exhibit 12a,b,c,d). 13. On 11/14/091 went to the Cumberland County Courthouse to file for a hearing date in the Court of Common Pleas, as per the Penn Dot instructions. I was told by employees at the courthouse that I could not "just Petition the Court" and request a date, that Penn Dot had it wrong and was always sending them people, that I had to request such through an attorney and that there were no forms to complete a request for such. They gave me the number for the Bar Association, whom I immediately called. They did not return my call. I called again on 11/17. They gave me the number of an attorney. I contacted that attorney on 11/19/09, who said he does not handle such (Exhibit 13). 1 contacted the Bar Association again and got the n6ft of another attorney, who could provide me with the forms to file, for a $25.00 consultation fee. 14. On 11 /24/ 08 Penn Dot granted us another registration extension (Exhibit 14). 15. On 11 /25/09, 1 met with that attorney who stated that to request such from the Court in Cumberland County required the use of an attorney in Cumberland County, and that much research, etc., by the attorney would need to be done, for quite a sum, in order to request a Court Order by the judge. I begged to do it myself. The attorney finally gave me some examples, but was doubtful the judge would accept my self written documentation and request. 16. On 12/30/09, a letter from the Attorney General's office revealed that they had attempted to mediate the complaint. A#ached to their letter was a letter from one of the owners of FaMily Pre-Qwned, stat" that the dealership had closed, that my title situation had been handed and that the title was now at the state level (Exhibit 15 a and b). 17. On 12/31/08, 1 wrote certified letters to Family Pre-Owned (Exhibit 16) and the prior owner's of record (exhibit 17) regarding the efforts to Quiet the Title and to request such of the courts; as, as of that date, I had not yet received the 12/30/09 letter from the Attorney General's Office. The Family Pre-Owned letter was retuned, unopened on 1/7/09 (Exhibit 18). The prior owner's letter had been delivered, a return receipt did arrive, however, the signature is not legible (Exhibit 19). The cost for this transaction was $19.04. 18. On 1/14/09, 1 called Penn Dot, Kathy Mumma, to check if the 12/12/09 statement by Family Pre-Owned, as found in the Attorney General's Response, had been satisfied with regard to the title now residing with the State, She did not return my call (Exhibit 20). 19. On 1/28/09, my spouse and I went to Penn Dot with all of the materials (stated above and more), to check on the status of the Title. We met with Kia and a supervisor, in the conference room (Exhibit 20). Our files were reviewed, including the certified letter responses and the responses from the Attorney General's office. Kia took our copies of the original title from the othor oWnero and went to work with a supervisor to check the status. When she returned with the supervisor, we were told that there was no need to fife further with the Court. That at least 50 other individuals were in the same predicament from Family Pre-Owned, and that the matter was sent to Penn Dot insurance. They stated they would continue to provide us with updated temporary registrations every 3 months until the matter hit "BOND" and then Penn Dot would be able to process all the paperwork. We were told to come back the end of February to receive our updated registration (Exhibit 21). 20. On 5/15/09, we went to Penn Dot to receive another temporary Registration; as the registration was due to expire on 5/18/09. We were told at that time, by Kathy Mumma, that we needed to proceed with a request to Petition the Cumberland County Court to Quiet the Title and obtain a Court Order releasing all other parties in order to make the vehicle ours. She stated that they would no longer issue to us a temporary registration. Despite our having discussed the items and notes from number 18 above, she still would not grant us even an additional week. I contacted the Cumberland County Prothonitary office, at Penn Dot's request, to ask how to proceed with such. These documents have been submitted as a result of instructions from the Court Office and directions from Penn Dot. I, Ellen J. Castagneto, hereby certify that all of the above statements are true. PA.19107 PA State Police, 1800 Elmerton Avenue, Harrisburg, PA 17110 Reference: 2001 Saturn, L Series, VIN# 1G8JU5281Y533329 To Whom It May Concern: We are filing a complaint about the unethical, and perhaps illegal, business practices that occurred when we recently boughiwour graduating daughter a 2001 Saturn from Family Pre- Owned Auto Sales, 6350 Baltimore Ave., Femwood PA 19050. On May 26, 2008, we purchased, cash, the above listed automobile for our 17 year old daughter, who is now attending the Unhrarsity of Delaware. We paid for the car, registration, tax, tags, and a 6 month warranty with GWC (see attached receipt). The temporary registration was due to expire on August 26, 2008. By mid August, when we did not receive the title and official registr0on in the mail, we went to Penn Dot to get it. We found. out,. at that time, that the business had. never sent in- the registration. bformation,. fees, or taxes. They encouraged us to contact the business. Each of us contacted the business for about two weeks: via phone, left messages, and via fax. We received no response. During this period of time, we also contacted GWG They also had no record of the $400.0Q warranty that we had purchased on 5/26108 and stated that they had never received any information regarding our vehicle from Family Pre-Owned Auto Sales. They told us to fax our receipt copy to them, GWC. We did such, and stilt have not heard from- GWC. Upon 3 returns to Penn Dot, Penn Dot revealed that the matter was under investigation, other individuals had also reported similar issues wilt the same business, and Penn- Dot issued- us another temporary, through November, registration. They suggested that we Me a complaint with the attorney general's office and.the state police. We are wondering if the company ripped us off, stole the car, if the car was involved in. a crime, etc., etc., etr We are very concerned about this matter. We do not have the title, official final registration, or the warranty that we purchased. We have been stopped by the police once already due to the temporary tags. I am worried that they will also stop our 17 year old daughter white she is at college. Please advise at your earliest convenience. Regretfully, the Bureau is unable to comply with the request for title and registration. In order to obtain a Pennsylvania certificate of title it will be necessary for you to file suit in Common Pleas court in your jurisdiction requesting that an order be entered that (1) awards ownership of the subject vehicle to the applicant and (2) extinguishes the right, title and interest of any other said person of said vehicle. The Department would then be able to accept such a court order as evidence of ownership in lieu of a certificate of title. In order for a certificate of title to be issued, a certified copy of that Court Order must accompany a completed MV-1 form, and evidence satisfactory to the Department that reasonable notice of the court proceeding was provided to any vehicle owner listed on Department record, and any other interested party, including anyone whose lien is endorsed upon the certificate of title for the vehicle according to the record of the Department. The department is aware that the business where this vehicle was purchased had collected sales tax, title and registration fees. The Department has a Recovery Fund for such fees, however the procedure above must be completed first and sent to the Department.
