WHEREAS, JOSEPH R. RUBERTONE and SUZANNE RUBERTONE of 5249 Meadowbrook
Drive, Mechanicsburg, Pennsylvania, is about to execute contemporaneously herewith, a contract, with
Yingst Homes Inc. of 4712 Smith Street, Harrisburg, Pennsylvania, for the erection of a building upon
premises commonly known as Lot 11 Brigade R, oad, Tpwnship East Pennsboro, Cumbelra~.d~County,
P. ennsylvania, as set forth in the deed dated ///~.,/_._t~[ , recorded at Deed Book,~/?/ 7 , Page
/_.~, in the Recorder's Office for CUMiSERLAND mo~e
County,
Pennsylvania,
as
described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, , at the time of and immediately before the execution of the principal contract, and before
any authority has been given by the said Owner to the said Contractor to commence work on the said
building, or purchase materials for the same in consideration of the making of the said contract with
Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed
that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the
materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or
materials purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN .lot or tract of land situate in East Pennsboro
Township Cumberland County, Commonwealth of Pennsylvania, more
particularly bounded and described as follows, to wit:
· BEGINNING at a point on the eastern dedicated right-of-way line of
Brigade Road at the dividing line of Lot # 12 and Lot # 11, said point also being
76.90 feet east on'the eastern extremity of an arc connecting northern right-of-
way line of Brigade Road and the eastern dedicated right-of-way line of Jenkins
Grove;
THENCE by line of Lot #12 North 08 degrees 16 minutes 35 seconds
West 97.96 feet to a point; Thence by Other Lands of Whelan Crossing North
66 degrees 09 minutes 51 seocnds East 67.91 feet to a point at the diving line'
of Lot.#10 and Lot #11; Thence by line of Lot #10 South 43 degrees 21 minutes
18 seconds East 57.01 feet to a point on the northern right-of-way line of
Bridged Road Cul-de-sac; Thence by said right-of-way line by.a curve to the left
having a radius of 50.00 feet and an arc length 49.17 feet to a point; Thence by
same by a curve to the right having a radius of 15.00 feet and an arc length of
16.86 feet to a point on the northern right-of-way line of Bridged Road; Thence
by said right-of-way line ~by a curve to the right having a radius of 125.00 feet
and an arc length of 58.91 feet to a point; Thence by same South 81 degrees 43
minutes 25 seconds West 12.00 feet to a point at the dividing line of Lot-#12
and Lot # 11, the pla'ce of beginning.
CONTAINING 8,434 square feet.
BEING Lot # 11 on the Final Subdivision Plan for Whelan Crossing Phase
I and II prepared by ACT ONE Consultants, Inc. dated July 19, 1996, last
revised November 4, 1996, recorded in the Office of the Recorder of Deeds in
and for Cumberland County, Pennsylvania, on February 14, 1997, in Plan
Book 74, Page 6. ,
