Schmalz IN RE: IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA D.E.K. NO. 2000 - 50f f CIVIL TERM CIVIL ACTION - LAW CUSTODY AGREEMENT 1. MOTHER is Kristin S. Kaufman, who currently resides at 403 South Baltimore Street, Apartment U, Dillsburg, York County, Pennsylvania. MOTHER will be relocating to Ohio in the immediate future. 2. FATHER is Mark E. Kaufman, who currently resides in Fort Rucker, Alabama. 3. MATERNAL GRANDMOTHER is Irene B. Schmalz who currently resides at 212 West Main Street, Shiremanstown, Cumberland County, Pennsylvania. 4. MOTHER and FATHER are the natural parents of a minor son, DANIEL E. KAUFMAN, age 16, whose date of birth is April 4, 1984. 5. MOTHER and FATHER agree that upon the execution of this Agreement, MATERNAL GRANDMOTHER shall have primary physical custody of the minor child. Physical custody shall be defined as the right to keep, control, guard, care for and preserve the child. 6. The parties shall share legal custody of the child. The child's custodial parent or grandparent shall make any and all emergency decisions necessary without prior consultation with the other parties, however shall be responsible for promptly informing the non-custodial parent of any such emergency. Legal custody shall be defined as the right to make major decisions including, but not limited to, medical, educational, religious, and extracurricular decisions on the child's behalf. MOTHER shall provide MATERNAL GRANDMOTHER with her new address and telephone number in Ohio as soon as that information is available so as to facilitate the above. 7. MOTHER shall be entitled to spend one (1) weekend per month with the child in Pennsylvania and FATHER shall be entitled to visit with the child when he is in Pennsylvania, with the specific dates and times to be agreed upon by all parties to this Agreement. Furthermore, both parents shall be entitled to liberal telephone contact with the child. 8. The minor child shall be enrolled in the Mechanicsburg School District, and shall complete his high school education at the Mechanicsburg High School, which is the District in which MATERNAL GRANDMOTHER resides. 9. It is anticipated that both MOTHER and FATHER will be remain involved in their son's life, however at this point in time, all parties agree that it is in the child's best interest to be in the primary legal and physical custody of MATERNAL GRANDMOTHER. 10. FATHER shall maintain health and medical insurance coverage for the minor child for as long as the child is eligible. 11. The parties intend that this Agreement shall be made into an Order of Court.
