Protection From Abuse 11. Other details of the court action are: -Defendant obtained temporary PFA order against Plaintiff in Cumberland County at docket number 4505 Civil term. Hearing in this matter is scheduled for August 9, 2000, at 11:00 am., in Courtroom No. 4. -Plaintiff filed led custody action in Cumberland County on July 11, 2000. ( PA M. &V - AZC&J-p 4 PA 1-i. ,.. 12. Plaintiff and Defendant are the parents of the following minor child/ren: a. Khelsea Lynne Reed Age:S Child's address is: 719 Cumberland Point Circle , Mechanicsburg, PA 17055 b. Samantha Dawn Reed Age:6 Child's address is: 719 Cumberland Point Circle, Mechanicsburg, PA 17055 13. There is an existing court order regarding the custody of the Plaintiffs and Defendant's minor children. The terms of the order are: Defendant received primary physical custody of children through above-cited temporary PFA order. Plaintiff receives custody on alternating weekends from Friday until Sunday and any other time by agreement of parties. County: Cumberland State: PA 14. Plaintiff is seeking an Order of child custody as part of this petition. The following is a list of the children and where they have five for the past 5 years: a. Khelsea Lynne Reed For the past 5 years, this child has lived with: -Plaintiff (Father) and paternal grandparents at 2552 Tiffany Lane, Harrisburg, PA, from 7/3/2000 to 7/11/2000. -Plaintiff (Father) and Defendant (Mother) at 719 Cumberland Point Circle, Mechanicsburg, PA, from 11/99 to 7/3/2000. -Plaintiff and Defendant in Center, Missouri, from 7/97 to 11/99. -Plaintiff and Defendant in New London, Missouri, from 6/94 to 7/97. b. Samantha Dawn Reed For the past 5 years, this child has lived with: -Plaintiff (Father) and paternal grandparents at 2552 Tiffany Lane, Harrisburg, PA, from 7/3/2000 to 7/11/2000. -Plaintiff (Father) and Defendant (Mother) at 719 Cumberland Point Circle, Mechanicsburg, PA, from 11/99 to 7/3/2000. -Plaintiff and Defendant in Center, Missouri, from 7/97 to 11/99. -Plaintiff and Defendant in New London, Missouri, from 6194 to 7/97. 15. The facts of the most recent incident of abuse are as follows: On about Tuesday, May 30, 2000 location: Bedroom of marital residence. -Defendant started loud argument with Plaintiff in bedroom. When Plaintiff attempted to leave the room, Defendant ran after him with a nail file, threatening to stab him with it. Plaintiff protected himself by pushing Defendant away from him and holding her against the wall. 16. Prior incidents of abuse that the Defendant has committed against Plaintiff or the minor child/ren, (including any threats, injuries, or incidents of stalking) are as follows: -Incidents which occurred in the past six months include the following: . -Defendant threatened to stab Plaintiff with a kitchen knife; -Defendant locked Plaintiff in the bedroom and refused to let him out; . -Defendant has started numerous arguments and then caused them to escalate into physical altercations wherein she punched Defendait on,the body and/or slapped him in the face. T -In October 1999, Defendant, while intoxicated; became extremely belligerent and started punching Plaintiff. -On New Year°s Eve 1998, Defendant attacked Plaintiff in the home of a third party. Defendant iniured Plaintiffs neck and gave him a black eye. 17. The police department(s) of law entbrcelnent agencies that should be provided with a copy of the protection order are: Lower Paxton Police 18. There is an immediate and present danger of further abuse from the Defendant. 19. FOR THE REASONS SET FORTH ABOVE, I REQUEST THAT THE COURT ENTER A TEMPORARY ORDER, and AFTER HEARING, A FINAL ORDER THAT WOULD DO THE FOLLOWING: a. Restrain Defendant from abusing, threatening, harassing, or stalking Plaintiff and/or minor child/ren in any place where Plaintiff may be found. b. Award Plaintiff temporary custody of the minor child/ren and place the following restrictions on contact between Defendant and chid/ren: -Grant primary physical custody to Plaintiff and partial physical custody to Defendant. Defendant may have partial custody on alternating weekends from Saturday to Sunday. c. Prohibit Defendant from having any contact with Plaintiff and/or minor child/ten, either in person, by telephone, or in writing, personally or through third persons, including but not limited to any contact at Plaintiff s school, business, or place of employment, except as the court may find necessary with respect to partial custody and/or visitation with the minor child/ren. d. Prohibit Defendant from having any contact with Plaintiffs relatives and Plaintiffs children listed in this petition, except as the court may find necessary with respect to partial custody and/or visitation with the minor child/ren. e. Order Defendant to temporarily turn over weapons to the Sheriff of this County and prohibit Defendant from transferring, acquiring, or possessing any such weapons for the duration of the Order. f Order Defendant to pay the costs of this action, including filing and service fees. g. Order Defendant to pay Plaintiffs reasonable attorney's fees. h. Grant such other relief as the court deems appropriate. i. Order the police or other law enforcement agency to serve the Defendant with a copy of this Petition, any Order issued, and the Order for Hearing. Samantha Dawn Reed Until the final hearing, all contact between Defendant and the child/ren shall be limited to the following: The parties shall share legal custody of the children and Plaintiff shall have primary physical custody of the children. Defendant shall have partial physical custody of the children everyother weekend from Friday until Sunday, and at, other dates and times agreed upon by the parties. The children shall be returned to Plaintiff Tuesday, July 11, 2000, upon their return from vacation with the paternal grandparents. The local law enforcement agency in the jurisdiction where the child/ren are located shall ensure that the child/ren are placed in the care and control of the Plaintiff in accordance with the terms of this Order. 6. A certified copy of this Order shall be provided to the police department where Plaintiff resides and any other agency specified hereafter: Upper Allen Police Department Lower Allen Police Department 7. The sheriff, police or other law enforcement agencies are directed to serve the Defendant with a copy of the Petition, any Order issued, and the Order for Hearing without prepayment of costs. The Petitioner will inform the designated authority of any addresses, other than the Defendant's residence, where Defendant can be served. Defendant shall immediately relinquish any firearms license the Defendant may possess, and the following weapons to the Sheriffs Office or a designated local law enforcement agency for delivery to the Sheriffs Office. Defendant is prohibited from possessing, transferring or acquiring any other firearms license or weapons for the duration of this order. 6. The following additional relief is granted: - Prohibit Defendant from having any contact with Plaintiffs relatives and Plaintiff's children listed in this petition, except as the court may find necessary with respect to partial custody and/or visitation with the minor child/ren. - Order Defendant to pay the costs of this action, including filing and service fees. - Order Defendant to pay Plaintiff's reasonable attorney's fees. 7.
