SPRAITZAR, a sui juris adult, who currently resides at 250 Union Hall Road, Carlisle, Cumberland County, Pennsylvania, since June 30, 2000. 2. Defendant is MARY V. SPRAITZAR, a sui juris adult, who currently resides at 14 Brantley Place Carlisle, Cumberland County, Pennsylvania, since March, 2000. 3. Plaintiff and Defendant have been bona fide residents in the Commonwealth for at least six months immediately previous to the filing of this Complaint. 4. The Plaintiff and Defendant were married on July 6, 1974 in Collingswood, Camden County, New Jersey. 5. There have been no any actions of divorce or annulment of marriage between the parties except the action represented by this Complaint. 6. The marriage is irretrievably broken. 7. Neither the Plaintiff nor Defendant is a minor or incompetent. 8. Plaintiff has been advised that counseling is available and that Plaintiff may have the right to request that the court require the parties to participate in counseling. 9. Plaintiff requests the court to enter a decree of divorce. COUNT II EQUITABLE DISTRIBUTION - SECTION 3502 10. The allegations of paragraphs 1 through 8 hereof are incorporated herein as fully as though set out at large. 11. the parties have been unable to determine and equitably dispose of their respective rights and interests in the marital property. 12. Plaintiff will, within 60 days after service of this Complaint upon the Defendant, cause to be filed an inventory and appraisement of all property owned or possessed at the time this Complaint is filed. SPRAITZAR, Defendant IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NO. 00 - 5028 CIVIL IN DIVORCE THE MASTER: Today is Thursday, October 31, 2002. This is the date set for a Master's hearing in the above captioned divorce proceedings. The testimony today was to begin with the factor of marital misconduct. The Master has been advised that that issue is not going to be part of these proceedings and, therefore, we did not have to have any testimony on that factor as relating to alimony. The parties and counsel have taken the time this morning to continue negotiations and the Master has been advised that they have reached an agreement with respect to the outstanding economic claims. Present in the hearing are the Plaintiff, William S. Spraitzer, and his counsel Martha B. Walker and Teri Hall Stiltner. Also present is the Defendant, Mary V. Spraitzer, and her counsel Rebecca R. Hughes. This action was commenced by the filing of a complaint in divorce on July 18, 2000, raising grounds for divorce of irretrievable breakdown of the marriage. Although a 3301(d) affidavit.was filed on March 28, 2002, averring a period of separation in excess of two years, the parties have I provided the Master with affidavits and consent and waivers of notice of intention to request entry of divorce decree which have been signed and dated today by both parties. The Master's office will file the affidavits and waivers with the Prothonotary's office so that the divorce can conclude under Section 3301(c) of the Domestic Relations Code. The complaint also raised a claim for equitable distribution; an amended complaint was filed on April 10, 2002, raising additional economic claims of alimony, alimony pendente lite, and counsel fees and costs. The Master, as noted, has been advised that the parties have reached a comprehensive agreement with regard to the economic claims. An outline of the agreement is going to be placed on the record and counsel have indicated that they are going to prepare a formalized agreement to encompass the terms of settlement as stated on the record. The agreement as stated on the record, however, will be considered the substantive agreement of the parties not subject to any changes or modifications except for correction of typographical errors. Consequently, the substance of the agreement cannot be altered following the statement of the agreement on the record. The Master has been advised that if he does not have a signed agreement by the parties within thirty (30) days of today's date he will send to the Court the transcript of today's proceedings as the agreement of the parties even though it has not been signed by the parties affirming the terms of settlement and ask the Court to vacate his appointment. At that time, the statement of the agreement on the record will be considered the agreement of the parties and the parties will be bound thereto. After the agreement has been forwarded to the Court, either the transcript or the signed agreement, the Master's appointment will be vacated and counsel will then be in a position to file a praecipe transmitting the record to the Court requesting a final decree in divorce. The parties were married on July 6, 1974, and separated March 5, 2000. They are the natural parents of four children, three of whom are emancipated and a minor child living with the wife. (A discussion was held off the record.) THE MASTER: The daughter who is living with the wife is 18 but is still a student in high school so for our purposes she would be considered a dependent child. Ms. Walker. MS. WALKER: 1. The parties have agreed by way of equitable distribution that the vehicles described as a Honda and a Voyager shall be transferred to husband as well as the TYCO stock. 2. Husband shall retain his FERS retirement and his U.S. Army Reserves pension without claim by wife. 3. Husband shall be responsible for the Keystone Financial debt, the Sears debt and the Citibank debt. In addition, until the parties' marital home on Union Hall Road in Carlisle, Pennsylvania, sells, husband shall be responsible for making the first and second mortgage payments on the property. 4. Wife is entitled to receive the sum of $144,121.00. This will be paid to wife by virtue of rolling over the marital portion of husband's TSP retirement account in the amount of $82,908.16 to wife to an IRA established by her as well as the non-marital portion of the TSP which as of the date of May 1st was $21,327.69. There were additional funds accruing with additions and interest to the non-marital portion of the TSP which shall by paid over by virtue of the IRA roll over as a credit against the $144,121.00 that wife needs to obtain. In addition, any proceeds remaining from the sale of the parties's home, after the real estate commission, current mortgage balances, and costs are paid, shall also be applied to wife obtaining the $141,121.00. Any difference then remaining shall be amortized on a note payable to wife from husband carrying the rate of 5%. That note shall be amortized over a period of three years if husband's gross income from his employment sources exceeds $90,000.00. In the event husband's income is less than $90,000.00 gross from earned income, then the note shall be reamortized and put on a five year amortization schedule. On the promissory note due to wife, payments shall not commence in any event until the house sells, in which case the payments shall start one month following the date of settlement of the house. 5. In regard to alimony, the parties agree that alimony shall commence for a period of nine years from the date of the parties' divorce. In the event that husband's gross income from earned sources is $90,000.00 per year or more, he shall pay the sum of $1,300.00 monthly for alimony. In the event that his gross income is $80,000.00 to $90,000.00 annually he shall pay the sum of $1,000.00 per month alimony. And in the event his income is less than $80,000.00 per year, the amount of alimony shall be $800.00 per month. This alimony is non-modifiable over this nine-year period. Alimony is terminable upon the death of either party or upon wife's remarriage or cohabitation. Annually, husband shall be required by February 28 to supply wife with his original W-2 and by May 15 of each year husband shall be required to supply wife with a copy of his income tax return. If there are to be changes in the amount of alimony based on the changes of gross income of husband, then the new amount shall start on the next January 1 so that alimony is based on a calendar year basis. In regard to a failure by husband to timely provide W-2 and income tax returns to wife annually, the alimony shall remain at the $1,300.00 per month level. 6. Husband shall pay all of the costs of these proceedings. 7. The parties agree to a mutual waiver of any claim against each other for counsel fees. 8. Except as herein otherwise provided, each party may dispose of his or her property in any way and each party hereby waives and relinquishes any and all rights he or she may now have or hereafter acquire under the present or future laws of any jurisdiction to share in the property or the estate of the other as a result of the marital relationship including without limitation, statutory allowance, widow's allowance, right of intestacy, right to take against the will of the other, and right to act as administrator or executor in the other's estate. Specifically, my client's understanding is that when he took out this additional mortgage, that he paid all the credit card bills with the proceeds. Furthermore, please provide the original documents associated with this loan. It was my client's understanding that this was a line of credit, and if so, we need a full history of transactions from the inception date of the loan. With reference to the current balance on the first mortgage, again, please provide a recent statement reflecting the same. Fourth, with reference to the PSP account, please provide an updated statement so that the full marital portion of the PSP can be determined.
