TO: Diana Loyer, et. al
TAKE NOTICE that Claimant/Plaintiff SAMTAY, INC. has filed a mechanic's lien
claim against the property located at 6 Poplar Street, Wormleysburg, Pennsylvania, more
particularly described in a Deed (a true and correct copy of which is attached to the enclosed
Mechanics Lien Claim, which is the property to be encumbered by this Claim For Mechanic's
Lien.
This lien claim was filed on WEDNESDAY, MAY 27, 2009 in the office of the
Prothonotary in and for the County of Cumberland, Pennsylvania, and docketed to the docketing
number shown at the top right of this notice.
Attached is a copy of the said claim

CLAIM FOR MECHANIC'S LIEN
1. SAMTAY, INC. d/b/a/ PAUL DAVIS RESTORATION OF LANCASTER LEBANON,
pursuant to the Mechanic's Lien Law of 1963, P.L. 1175, No. 497, Section 503 (49 P.S. 1503),
files this claim of lien as a contractor against Diana Loyer, et. al., owner, and against the building
and premises herein described and the cartilage appurtenant thereto, for the debt of $15,943.56
(fifteen thousand, nine hundred forty-three dollars and fifty-six cents, together with lawful
interest from April 16, 2009, due to Claimant/Plaintiff as Contractor in the repairs of said
building as approved and paid for by the property owner's insurance company.
2. Claimant/Plaintiff is SAMTAY, INC., a Pennsylvania Business Corporation trading
pursuant to a fictitious name registration as PAUL DAVIS RESTORATION OF LANCASTER
LEBANON, with an office for the regular conducting of business at 1817 Colonial Village Lane,
Lancaster, PA 17601.
3. The work described below was completed on December 18, 2008.
The name of the owner of the premises and building against which this claim is filed is Diana R.
Loyer, whose address is 6 Poplar Street, Wormleysburg, Pennsylvania.
4. The Claimant contracted directly with Diana Loyer.
5. The labor and materials furnished, on which this Mechanics Lien Claim is based, was for
structural repairs to the property as the result of a fire loss which originated four (4) doors down
affecting the entire property of 6 Poplar Street, Wormleysburg, PA, more particularly described
in a Deed (a true and correct copy of which is attached hereto and incorporated by reference
herein as Exhibit A-1) from Timothy and Eileen Holtzman (seller) to Diana R. Loyer dated
January 4, 2000, in the Office for the Recording of Deeds in and for Cumberland County,
Pennsylvania, which is the property to be encumbered by this Claim for Mechanics' Lien.
6. The Claim of the Claimant is based upon an Oral and Written agreement (Exhibit B) on
or about January 14, 2008 and written agreement on or about January 14, 2008, by which Diana
Loyer engaged Claimant/Plaintiff to do the work and supply the material set forth in the said
estimates, which is attached hereto and incorporated by reference herein as Exhibit C on a time
and materials plus overhead and profit basis (as is set out on Exhibit C).
7. The prices for time and materials shown on Exhibits C hereof are the fair and reasonable
prices therefore.
8. The specific work done and materials supplied are as shown on Exhibit C.
9. Claimant billed owners periodically for the labor performed and the materials furnished.
A total of $37,160.66 was billed.
a. Diana Loyer issued partial payment in the amount of $21,217.10 to Paul Davis
Restoration for draw payments.
b. The sum of $15,943.56 as per invoices shown on Exhibit D, together with
lawful interest from April 16, 2009 as well as Administrative fees of $125.00
and Court Filing fees in the amount of $19.00 for a total of $144.00 for fees,
remains unpaid and is now due the Claimant. The Claimant has no note or
other collateral security for his claim.
11. The work was done between January 14, 2008 and December 18, 2008.

verification to be made), of which I am the Director of Construction, have read the foregoing and
hereby affirm that it is true and correct to the best of my personal knowledge, or information and
belief. This verification and statement is made subject to the penalties of 18 Pa. C.S.A. §4904
relating to unsworn falsification to authorities.

COMPLAINT UPON A MECHANICS LIEN
1. Plaintiff, SAMTAY, INC. d/b/a, PAUL DAVIS RESTORATION OF LANCASTER
LEBANON is a Pennsylvania corporation, with its principal office located at 1817 Colonial
Village Lane, Lancaster, PA 17601.
2. Plaintiff, SAMTAY, INC. d/b/a, PAUL DAVIS RESTORATION OF LANCASTER
LEBANON is in the business of insurance restoration and remodeling. Plaintiff, SAMTAY,
INC. d/b/a, PAUL DAVIS RESTORATION OF LANCASTER LEBANON is a contractor.
3. Defendant, Diana Loyer, is an adult citizen residing in Pennsylvania, and having a
principal residence at 6 Poplar St., Wormleysburg, PA 17043.
4. Defendant, Diana Loyer, is the rightful owner of property located at 6 Poplar St.,
Wormleysburg, PA 17043. A true and correct copy of the current deed is attached as Exhibit
"A-1."
5. On January 14, 2008, Plaintiff, SAMTAY, INC. d/b/a, PAUL DAVIS
RESTORATION OF LANCASTER LEBANON contracted with Defendant, Diana Loyer, to
provide structural repairs to the property as the result of a fire affecting majority of rooms in the
home. The contract was dated January 14, 2008. A true and correct copy of the contract is
attached as Exhibit "B."
6. On, December 18, 2008, Plaintiff, SAMTAY, INC. d/b/a, PAUL DAVIS
RESTORATION OF LANCASTER LEBANON completed work pursuant to the agreed upon
contract.

We agree that the total cost of the work will be in accordance with the original estimate and any supplemental
estimates prepared by Contractor and approved by the adjuster for our insurance company, plus any change

This work authorization, along with all approved estimates, supplemental estimates and change orders shall
constitute the contractual obligations of the Owners and Contractor.
We understand that Contractor has no connection with our insurance company or its adjuster and that we alone
have the authority to authorize Contractor to make said repairs.
*We agree that any portion of work, such as deductibles, betterment, depreciation, or additional work requested
by us, not covered by insurance, will be paid in full. Please note: It is Contractor's company policy that
deductible amounts are collected prior to commencement of construction. Any issues or concerns must be
addressed at the time of signing this agreement.
Our mortgage payments are made to and we request them to protect the
interest of the Contractor in handling the loss draft or check.

proceeds due Contractor payable under our policy directly to Contractor and any mortgage company named. If
our names are included on the payment, we agree to promptly endorse said payment to mortgage company or
