1) Plaintiff, MORTGAGE GUARANTY INSURANCE COMPANY, as assignee of
DEUTSCHE BANK NATIONAL TRUST COMPANY, as Trustee for the
CERTIFICATEHOLDERS OF SOUNDVIEW HOME LOAN TRUST 2005-OPT1, ASSET
}
BACKED CERTIFICATES, SERIES 2005-OPT1, as successor in interest to OPTION ONE
MORTGAGE CORPORATION. (hereinafter referred to as "MGIC") is a corporation with its
principal place of business at 270 E. Kilbourn Ave, Milwaukee, WI 53202.
2) Defendant, ROBERT E LEE SR, is an individual who resides at 1154 BROCKTON
CIRCLE NEW CUMBERLAND, PA 17070.
3) Defendant, LAVERN K LEE, is an individual who resides at 1154 BROCKTON
CIRCLE NEW CUMBERLAND, PA 17070.
4) At all times relevant hereto, MGIC, was in the business as a private mortgage insurer
and is duly qualified and licensed.
5) At all times relevant hereto, MGIC, was the subrogee and assignee of any and all
claims paid to the mortgage holder on the property, 3510 Maryland Circle, SE, Cleveland TN 37323
hereinafter more fully described. See copy of assignment attached and marked as Exhibit A.
6) On or about March 30, 2005, Defendants executed a note for $100,700.00 for the
purposes of purchasing the property at 3510 Maryland Circle, SE, Cleveland TN 37323. The lender
was H&R Block Mortgage Corporation and pursuant to an allonge to the note it was assigned to
Option One Mortgage Corporation. A copy of the note and allonge are attached and marked as
Exhibit B.
7) On the above mentioned date, Defendants also executed a Deed of Trust giving a
mortgage in the above mentioned property. A copy of the Deed of Trust is attached and marked as
Exhibit C.
8). MGIC was the mortgage insurer on the property.
9) Subsequently thereto, Defendants defaulted on the note and the property was sold at
a foreclosure sale on December 21, 2006 for $80, 000.00 to DEUTSCHE BANK NATIONAL
TRUST COMPANY, as Trustee for the CERTIFICATEHOLDERS OF SOUNDVIEW HOME
LOAN TRUST 2005-OPT1, ASSET BACKED CERTIFICATES, SERIES 2005-OPT1, who then
became the Substitute Trustee. A copy of the Substitute Trustee's Deed is attached and marked as
Exhibit D.
10) At the time that the property was sold there was due and owing on the note the
amount of $104,383.68.
11) Thereafter, the Substitute Trustee made a claim with MGIC for the recovery of the
balance due on the mortgage which, at that time, was $26,437.35, and pursuant to the contract of
insurance, MGIC was obliged to pay said claim and did in fact pay the claim for $26,437.35. Copy of
the Claim for Loss is attached and marked as Exhibit E.
12) Tennessee is a non judicial foreclosure state, therefore the remaining amount due and
owing is the amount due at the time of foreclosure less the bid amount, or $24,383.68
13) MGIC, as subrogee, seeks reimbursement up to the amounts actually paid pursuant to
the contract of insurance.
14) As the result of the default by the Defendants pursuant to the underlying note and
mortgage, all obligations of the Defendants became immediately due and payable.
15) By reason of the default, the Defendants are indebted to the Plaintiff for sums that
may be due and owing.
16) Plaintiff seeks the deficiency balance due of $24,383.68 from the Defendant, an
amount lesser than the actual insurance claim paid, and no part of which has been paid subsequent to
the default.
WHEREFORE, Plaintiff, MORTGAGE GUARANTY INSURANCE COMPANY, as
assignee of DEUTSCHE BANK NATIONAL TRUST COMPANY, as Trustee for the
