Plaintiff, RELIANCE FUNDING COMPANY (hereinafter "Plaintiff") is a corporation doing business at 8730 Wishire Blvd., Suite 350, Beverly Hills, California 90211. 2. Defendants, VICTOR ASHBY and MELISSA ASHBY (hereinafter "Defendants") are husband and wife, with a last known address of 215 Cavalry Road, Carlisle, PA 17013. 3. In 2008, Plaintiff changed its name from Reliance Finance Company to Reliance Funding Company. 4. Reliance Funding Company is the successor in interest to Reliance Finance Company. COUNT I - RELIANCE FUNDING COMPANY, AS SUCCESSOR IN INTEREST TO RELIANCE FINANCE COMPANY v. VICTOR ASHBY AND MELISSA ASHBY - Reliance Funding Company, successor in interest to Reliance Finance Company v. Victor Ashby and Melissa Ashby - Complaint page 4 BREACH OF CONTRACT 5. Plaintiff hereby incorporates by reference Paragraphs 1 through 4, inclusive, of its Complaint, as if the same were set forth in full herein. 6. On or about May 11, 2007, Defendants completed and signed a Credit Application and Installment Contract for the purpose of obtaining a loan from Plaintiff. A true and correct copy of said Credit Application and Installment Contract is attached hereto as Exhibit 1. 7. In reliance on the information provided on the Credit Application and Installment Contract and subject to the terms therein, Plaintiff loaned $6,285.36 to Defendants. 8. Pursuant to the terms of the Credit Application and Installment Contract, Defendants were to pay Plaintiff $213.69 per month beginning on July 1, 2007. See Exhibit 1. 9. Defendants have not made any payments to Plaintiff on the money which was loaned to them. 10. Defendants have breached their contractual agreement with Plaintiff by failing to repay the money which was lent to them. 11. Pursuant to the terms of the Credit Application and Installment Contract, Defendants agreed to pay 19.9% interest per annum to Plaintiff. See Exhibit 1, page 4. 12. Plaintiff has repeatedly requested that Defendants pay the outstanding balance but Defendants have failed and refused to pay. 13. In addition to the aforementioned amount, Plaintiff requests interest at the Reliance Funding Company, successor in interest to Reliance Finance Company v. Victor Ashby and Melissa Ashby -Complaint page 5 contractual rate of 19.9% per annum from July 1, 2007. WHEREFORE, Plaintiff requests judgment in its favor and against the Defendants, VICTOR ASHBY and MELISSA ASHBY, jointly and severally, in the principal sum of $6,285.36, plus interest at a rate of 19% per annum from July 1, 2007, together with court costs.
