PEFFER, DECEASED FILE N0.2009-00242 FAMILY AGREEMENT AND FINAL RELEASE THIS AGREEMENT by and between RONALD D. PEFFER, individually and as Executor of the Estate of JACQUELYN L. PEFFER a/k/a JACQUELINE L. PEFFER, Deceased, and RICHARD CRONE, KEVIN J. HARING, NICHOLAS L. HARING, PAUL WILLIAM PEFFER, JR., and SYLVIA POWLEY, individually. WHEREAS, JACQUELYN L. PEFFER a/k/a JACQUELINE L. PEFFER, late of Cumberland County, Pennsylvania, died testate on February 16, 2009; having first made her Last Will and Testament dated September 11, 2007, which instrument was admitted to probate and is recorded in Cumberland County Courthouse, Register of Wills, File No. 2009-00242; WHEREAS, RONALD D. PEFFER has been duly appointed as Executor of the Estate of JACQUELYN L. PEFFER a/k/a JACQUELINE L. PEFFER, Deceased, and c~ ;,a ~:-,, ~_ ~ _. WHEREAS, RONALD D. PEFFER, RICHARD CRONE, PAUL WILLIAM PEFFER, JR. and SYLVIA POWLEY are each entitled to one-fifth (1/5) of the residuary property; mil/ WHEREAS, MELANIE HARING, who passed away on Mazch 7, 2009, did not survive Jacquelyn L. Peffer a/k/a Jacqueline L. Peffer by thirty (30) days; therefore, pursuant to Article IV of the Last Will and Testament, the shaze that was set aside for MELANIE HARING is to be distributed equally to her issue, per stirpes; WHEREAS, KEVIN J. HARING and NICHOALS L. HARING aze each entitled to one-tenth (1/10) of the residuary property, as being the issue of the late MELANIE HARING; WHEREAS, each of the parties to this Agreement have been furnished with a complete listing of the estate assets, receipts and disbursements as set forth on the Statement of Account as attached hereto and mazked as Exhibit A; WHEREAS, the parties to this Agreement each acknowledge to have received a proposed Schedule of Distribution attached hereto and mazked as Exhibit A; WHEREAS, it is the desire of the parties to this agreement that administration of this estate be completed and accomplished without a formal accounting and adjudication in the Orphans' Court Division of the Court of Common Pleas of Cumberland County, it being the desire of the parties to avoid the additional expense, delay and publicity of a formal accounting. NOW, THEREFORE, WITNESSETH, in consideration of the mutual promises, covenants and agreements recited herein, the parties do agree as follows: 1. RONALD D. PEFFER, Executor, does hereby state that he has fully and faithfully dischazged the duties of his office, and the Statement of Account (Exhibit A) is true and correct and fully discloses all significant transactions during the accounting period. He further states that all known claims against the Estate have been paid in full, and to the best of his knowledge there aze no claims outstanding against the Estate and all taxes presently due from the Estate have been paid. 2 WHEREAS, MELANIE HARING, who passed away on March 7, 2009, did not survive Jacquelyn L. Peffer a/k/a Jacqueline L. Peffer by thirty (30) days; therefore, pursuant to Article IV of the Last Will and Testament, the share that was set aside for MELANIE HARING is to be distributed equally to her issue, per stirpes; WHEREAS, KEVIN J. HARING and NICHOALS L.
