HomeMy WebLinkAbout06-04-09FAMILY SETTLEMENT AND FINAL RELEASE IN THE ESTATE OF ARTHUR G. WRIGHT JR. ESTATE NUMBER 21-08-853 KNOW ALL MEN BY THESE PRESENTS, that: WHEREAS, Arthur G. Wright, Jr., late of Cumberland County, Pennsylvania, died August 13, 2008, having first made his last Will and Testament which was duly executed on November 14, 1983; and, WHEREAS, the said last Will and Testament named his wife, Virginia L. Wright, Executrix of his last Will and Testament; and, WHEREAS, Letters Testamentary were duly issued by the Register of Wills of Cumberland County, Pennsylvania to Virginia L. Wright on August 19, 2008; and, WHEREAS, the Executrix has gathered the assets of the estate of the said decedent and the assets consisted of real estate and various investment accounts, to a total value of $261,757.18, as set forth in the Pennsylvania Inheritance Tax Return filed of record in this matter; and, WHEREAS, the Executrix has made distributions as follows: Lisa Betts Lisa Betts and Dana Brenneis Daeron C. Tamorria, formerly Karen Anne Guss, disclaimed her right to take title to the 75 acres of real estate in Mifflin County, Pennsylvania, along with her sisters, as indicated by the attached Disclaimer; and, WHEREAS, Dana Brenneis, natural mother of Liam Brenneis, Noah Brenneis, Keegan Brenneis and Aria Brenneis, acknowledges receipt of the sums paid on behalf of each child and hereby acknowledges and affirms that she will use each child's money for the sole benefit of said child and shall not use the children's monetary gift from the estate for her personal use; and, WHEREAS, the debts and deductions for administrative expenses, including the payment of Pennsylvania Inheritance Tax in the said estate, have been made leaving the remaining balance for distribution to Virginia L. Wright, the decedent's wife; and, WHEREAS, the balance for distribution has been reduced to cash and is available for distribution to Virginia L. Wright in accordance with the terms of the last will and testament of the said decedent; and, NOW, THEREFORE, KNOW YE, that we, the undersigned, being all of the heirs of the said decedent, do hereby acknowledge that we have received from the Executrix, in full satisfaction and payment of all sums of money, legacies, bequests and devises as are given, devised and bequeathed to each of us respectively by the said last will and testament, which amounts we have received as set forth herein; And each of us does hereby stipulate that in order to avoid the expense and time involved in the filing of a formal account and schedule of distribution, we agree that no account is necessary and we do hereby agree that we do consent to distribution being made in accordance with the decedent's last Will and Testament, without the filing of an account and schedule of distribution, the same to be with the same force and effect as if they had been filed and confirmed by the Orphans' Court Division of the Court of Common Pleas of Cumberland County. AND we and each of us do hereby remise, release, quitclaim and forever discharge the said Executrix, Virginia Wright, her heirs, executors and assigns, of and from the said estate and from all actions, suits, claims and demands whatsoever for by reason thereof, or for any other use, matter, cause or thing whatsoever, touching upon the estate of the said decedent, and each of us do further hereby covenant and agree that should should any liability come due to the estate of the said decedent after the signing of this agreement, we covenant and agree that we will pay pro-rata our share of the estate towards any legally enforceable claims, demands, suits, or causes of action which may be successfully prosecuted against the said estate or the aforesaid personal representative after the signing, sealing and delivery of this family settlement agreement and final release.
