1. The plaintiff is Hillary Auker who currently resides at 2
Subdivision Road, Newville, Pennsylvania, which is in Cumberland County,
Pennsylvania.
2. The defendant is Edward Eames who currently resides at 241
Middle Road, Newville, Pennsylvania, which is in Cumberland County,
Pennsylvania.
3. The plaintiff is seeking custody of the following child:

The child was born out of wedlock.
Since the date of birth of the child, the child has resided with the

The mother of the children is Hillary Auker, currently residing at 2
Subdivision Road, Newville, Pennsylvania.
She is single.
The father of the children is Edward A. Eames, currently residing at
241 Middle Road, Newville, Pennsylvania.
He is single.
4. The relationship of Plaintiff to the children is that of mother.
The plaintiff currently resides with the following persons other than
children:
No one.
5. The relationship of defendant to the children is that of father.
The defendant currently resides with the following persons other than
the children:
Derreck Castle (friend).
6. Plaintiff has not participated as a party or witness or in another
capacity, in other litigation concerning the custody of this child in this or
another court.
Plaintiff has no information of a custody proceeding concerning the
child pending in a court of this Commonwealth or any other state.
Plaintiff does not know of a person not a party to the proceedings who
has physical custody of the children or claims to have custody or visitation
rights with respect to the children.
7. The best interest and permanent welfare of the child will be
served by granting the relief requested because:
Plaintiff is willing and able to perform the primary parental
responsibilities for the children.
Plaintiff is in the best position to provide the care and nurture which
the child needs for healthy development.
Defendant is not capable of providing appropriate supervision for the
child. Incidents have occurred that makes the Plaintiff concerned about the
safety of the child if she was to be left alone with the Defendant. These
incidents include excessive drinking while the child was left in Defendant's
care to the point that he was unconscious and was not aroused when smoke
from the woodstove filled the entire home and the fire alarms were going
off. The Defendant also uses physical discipline on the child despite the
Plaintiffs requests for the Defendant not to do so.
8. Each parent whose parental rights to the child have not been
terminated and the person who has physical custody of the child have been
named as parties to this action.
WHEREFORE, plaintiff requests the court to grant her custody of the
minor child.

AND NOW, Wednesday, June 17, 2009 ,upon consideration of the attached. Complaint,
it is hereby directed that parties and their respective counsel appear before Jacqueline M. Verney, Esq. ,the conciliator,
at 4th Floor, Cumberland County Courthouse, Carlisle on Thursday, July 16, 2009 at 9:30 AM
for aPre-Hearing Custody Conference. At such. conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.
