STIPULATION AGAINST LIENS
THIS AGRE~NT made the ~},- day of November, 2001~ by
and between FARINELLI CONSTRUCTION, INC., of 3 Kacey Court, Suite
101, Mechanicsburg, PA 17055, hereinafter referred to as
Contractor, A~D WALTER L. POMEROY and LINDA L0 POMEROY, of 10
Cromwell court, Mechanicsburg, PA 15055, hereinafter referred to
as Owner, whereby the former undertook and agreed to erect anD
construe% a single family residential dwelling on that certai~
lot of ground situate on Foxfield Court, in Mechanicsburg, Silver
spring Township, Cumberland County, Pennsylvania, being Lot ~o.
110, Phase I, The Peninsula, said plan being recorded in Pla~
Book 65, Page 28. Being the same premises which Robert L.
Anderson and Mitzi Anderson. husband and wife, by Deed dated
April 23, 2001 and recorded April 30, 2001 in the Cumberland
Recorder of Deeds Office in Deed Book 243, Page 633, granted and
conveyed unto Walter L. Pomeroy and Linda L. Pomeroy, husban~ and
wife.
NOW THEREPORE, THIS AGR~El~E~T WITNESSETH~ That the saiI
Contractor, for and in consideration of the sum of One ($1.0~)
Dollar to it in hand paid by Owner, ~he receipt whereof is h~reb¥
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselv~u and their subcontractors, a~d
all parties actin~ through or under them, covenant and agree that
no mechanic

them or any of them against the said buildings and the lo% of
9round appurtenant thereto for or on account of any work done~or
materials furnished by them or any of them under said contrac~ or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described~
and the said Contractor, for themselves, their subcontractors
others under them hereby expressly waive and relinquish the r
to have, fils, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that ~his
instrument, waiving the right of lien, shall be an independel~
covenant, t
