Muniz (plaintiff) vs. Phillip Isaac and LaToya R. Isaac (defendants) Common Pleas No. 09-3890 civil COMPLAINT 1. Plaintiff Rosa N. Muniz is an adult individual residing at 105 Shirley Lane Boiling Springs Pennsylvania. 2. Defendant Phillip Isaac and LaToya R. Isaac residing at 529 N. Pitt St #2 Carlisle Pennsylvania. 3. On October 24, 2008 plaintiff leased the premises at 529 N Pitt St #2 Carlisle Pennsylvania to defendants under a residential lease agreement, a copy of which is attached hereto as Exhibit "A". 4. The lease provided for a term of one year, at a monthly rental of $675.00 payable in advance on the sixth of each month and $15.00 penalty if payment was late. 5. Defendants entered into possession of the leased premises on Nov. 1, 2008 in accordance with the term of the lease. Form 132.280-50 2 6. After Nov 6, 2008 defendant ceased to pay the rent due under the lease. The amount of rent in arrears is $4,725.00. 7. On May 9,2009 plaintiff made demand upon defendant for payment in the sum of $4,050.00 or to vacate the property but defendant has failed to pay the same amount or to leave the property 8. Defendants are still living in the property and failed to give notice to plaintiff of a hot water leak in the bathtub. As a consequence plaintiff received on June 4 a water bill for $1,243.92. Past bill was $283.90 a difference of $960.02, and 2 gas bills one for $287.62 March to April and another for $334.84 April to May. The average gas bill used to be $159.91. A difference of $303.46 for those 2 month. Total claim for utilities is $1,263.48. Copies are attached hereto as Exhibit "B". 9. Plaintiff' will apply defendant's security deposit in the amount of $600.00 in partial satisfaction of the $4,725.00 in back rent. Living a balance due to plaintiff of $4,125.00 for rent plus $105.00 for late fee. Pitt St#2, Carlisle, PA 17013 have this to say against the complaint; yes we know that we do owe rent but as agreed Mrs. Muniz was willing to wait until I received my disability money. I did not lead her on, I truly believed that I was going to win my appeal; however I didn't and my claim is in appeal again. Secondly, I didn't notify Mrs. Muniz of a leak in the bathtub because she was in Florida. At one point of time, the leak was really bad and we took it upon ourselves to fix it! Thirdly, I feel I shouldn't be held accountable for a water and gas bill when I was told directly from the tenants they had a leak also! Finally, Mrs. Muniz's apartment is not up to code. My son is sick from the apartment having a very high lead level. A normal level is below 10 and Reneer's is a 32! Also my ceilings are falling in and the walls are cracking.
