COMPLAINT
FACTUAL AVERMENTS
1. Plaintiff, Claims Recovery Systems, Inc. is a corporation with offices at 6 East
Main Street, Carnegie, Pennsylvania, and, for valuable consideration is an
assignee of the rights of West Asset Management Inc., an assignee of Worldwide
Asset Purchasing II, LLC., an assignee of Bank of America [Bills of
Sale/Assignments attached as Exhibits "A"] stands in its assignor's stead, and all
are hereinafter referred to interchangeably as "Plaintiff'.
2. Barbara Bevil is an adult individuals residing at 650 Walnut Bottom Road,
Shippensburg Pennsylvania 17257 [hereinafter referred to as "Defendant"].
3. Upon information and belief, Defendant made an application with Plaintiff for the
issuance of a line of credit on February 15'h of 1994, in the form of a, Bank of
America Visa Card. Said credit was utilized by the Defendant who accrued
charges of $17,981.02 until February 20`x' of 2006 when, due to non-payment, the
account was frozen and put into collections [See Exhibits "B" through "E" for
records of non-payment]. Interest accrued on this account at an annual percentage
rate of 32.24% after its sale to Worldwide Asset Purchasing II, LLC., leaving the
Defendant with a balance of $28,073.84 [see Exhibit `B"]. Interest was stopped
after sale to Plaintiff, Claims Recovery Systems.

COUNT I: BREACH OF CONTRACT
4. This count incorporates the preceding paragraphs one through three of Plaintiff's
Factual Averments.
5. In receiving said line of credit, Defendant agreed to the terms and conditions set
forth by Bank of America including repayment. These terms and conditions are
found in the disclosures in Plaintiff's Exhibits "B" though "E" and specifically set
out in the Visa Cardmember Agreement marked as Plaintiff's Exhibit "F"
6. Defendant failed to honor the agreement and neglected to make payments on the
line of credit and is therefore in breach of contract with Plaintiff.
7. Although repeatedly requested to do so by Plaintiff, Defendant has willfully failed
and/or refused to pay the principal balance or any part thereof to Plaintiff. To wit,
Defendant is indebted to Plaintiff in the amount of twenty eight thousand and
seventy three dollars and eighty four cents for charges made on the
aforementioned Bank of America Visa Card.
WHEREFORE, Plaintiff requests judgment in its favor and against Defendant in the
amount of $28,073.84 and court costs.

this Daily Balance by the Daily Periodic Rate to get your Periodic Finance Charge
for that day. We add these Periodic Finance Charges to your Dally Balance to get
the beginning balance for the next day.
To get your total Periodic Finance Charge for this Billing Cycle, we add all of the
Daily Periodic Finance Charges and round the sum to the next highest cent. This
amount is also equal to the Average Daffy Balance multiplied by the Daily periodic
rate times the number of days In the Billing Cycle rounded to the next highest
cent. To determine an Average Daily Balance, we add your Daily Balances and
divide by the number of days in the Billing Cycle.

For each day in the Billing Cycle, we take your beginning balance, add any new
transactions or other debits (including other fees and charges) and subtract any
payments or other credits. This gives us that day's Daily Balance. We multiply
this Daily Balance by the Dally Periodic Rate to get your Periodic Finance Charge
for that day. We add these Periodic Finance Charges to your Dally Balance to get
the beginning balance for the next day.
To get your total Periodic Finance Charge for this Billing Cycle, we add all of the
Daily Periodic Finance Charges and round the sum to the next highest cent. This
amount is also equal to the Average Dally Balance multiplied by the Daily periodic
rate times the number of days In the Billing Cycle rounded to the next highest
cent. To determine an Average Daily Balance, we add your Daily Balances and
divide by the number of days In the Billing Cycle.
We do this calculation separately for each feature such as Purchases, Cash
Advances, Balance Transfers or Promotional Balances. Periodic Finance Charges
begin to accrue from the later of the transaction date or the Statement Date of
the Statement on which the transaction appears.

FACTUAL AVERMENTS
1. Plaintiff, Claims Recovery Sy~tems, Inc. is a corporation with offices at 6 East
Main Street, Carnegie, Pennsylvania, and, for valuable consideration is an
assignee of the rights of West Asset Management Inc., an assignee of Worldwide
Asset Purchasing II, LLC., an assignee of Bank of America [Bills of
Sale/Assignments attached as xhibits "A"] stands in its assignor's stead, and all
are hereinafter referred to inte~{changeably as "Plaintiff'.
2. Defendant Barbara Bevil is a~ adult individuals residing at 650 Walnut Bottom
Road, Shippensburg Pennsylvania 17257 [hereinafter referred to as "Defendant"].

3. This count incorporates the pr~ceding paragraphs one through two.
4. Upon information and belief, efendant made an application with Plaintiff for the
issuance of a line of credit o February 15`h of 1994, in the form of a, Bank of

this Daily Balance by the Daily Periodlc Rate to get your Periodic FOiance Charge
for that day. We add these Periodic Finance Charges to your Daily Balance to get
Ole beginning balance for the next day.
To get your total Periodic Finance Charge for this Billing Cycle, we add all of the
Daily Periodic Finance Charges and round the sum to the next highest cent. This
amowrt is also equal to the Average Daily Balance multiplied by the Daily periodk
rate times the number of days in the Biltlng Cycle rounded to the next highest
cent. To determine an Average Daily Balance, we add your Daily Balances and
divide by the number of days in the Billing Cycle.
We do this calculation separately for each feature such as Purchases, Cash
Advances, Balance Transfers or Promotional Balances. Periodic Finance Charges
