COMPLAINT
1. Plaintiff Edward P. Bankes, Sr. is a patient in the Lebanon VA Medical Center, 1700 S.
Lincoln Avenue (Building #1, 5th Floor), Lebanon, PA 17042.
2. Cynthia M. Martin, daughter of Edward P. Bankes, Sr., resides at 101 Mill Street, Mt. Holly
Springs, PA 17065-1716.
3. Mark Martin, husband of Cynthia M. Martin, son-in-law of Edward P. Bankes, Sr. resides at
101 Mill Street, Mt. Holly Springs, PA 17065-1716.
4. Martin's Bella Customs is a partnership engaged in business at 55 Army Heritage Drive,
Carlisle, PA 17013.
5. Mark Martin and Cynthia M. Martin are partners in Martin's Bella Customs.
6. On or around October 30, 2007, Edward P. Bankes, Sr. loaned to Defendants the sum of
$45,000.00.
7. On or around March 6, 2008, Edward P. Bankes, Sr. loaned to Defendants the sum of
$7,000.00.
8. Defendants represented to Plaintiff that they were going to pay plaintiff back in the near
term either after they sold their business or otherwise.

9. The amount of time which has elapsed without Plaintiff being paid back the money he
loaned is far in excess of anything contemplated by any of the parties at the time the loans
were made.
10. Plaintiff should have been repaid the money no later than August 31, 2008.
11. Plaintiff is entitled to pre judgment interest at the rate of 6% per year from August 31, 2008
to the present.
12. Prejudgment interest from August 31, 2008 to May 20, 2009 equals $2,239.56.
13. After May 20, 2009, prejudgment interest continues to accrue at the rate of $8.5479 per day.
WHEREFORE, Edward P. Bankes, Sr. requests judgment against Cynthia M. Martin
and Mark Martin as individuals trading as Martin's Bella Customs in the amount of $54,239.56
plus $8.5479 per day for each day after May 20, 2009 up until the date an arbitration award or
judgment is entered.
