date, and it appearing to the Court that Thelma L. Bonarrigo was properly served with a Citati~ and N"otice
of this, hearing and that Patrick Moran, Thomas Moran, Megan Guion, Linda Plevelich and Kathleen
DeLurnba have all been served with the Petition for Guardian and the Notice of the Hearing, and based upon
the deposition of Albert J. Zanetti, D.O., the Court finds that the physical and mental condition of Thelma L.
Bonarrigo would be harmed by her presence at the hearing, and further finds from the testimony presented
at the hearing:
~ . That Thelma L. Bonarrigo suffers from an acute stroke, high blood pressure, dementia and
other physical ailments, the conditions or disability which impairs her capacity to receive and evaluate
information effectively and to make and communicate decisions concerning the management of her financial
affair's or to meet the essential requirements for her physical health and safety.
2. That there exists no other less restrictive alternative mechanism for decision making.
3. That based on the total incapacity of Thelma L. Bonarrigo to receive and evaluate information
and to make or communicate decisions, a plenary guardian of the person and a plenary guardian of the
estate are required on a permanent basis.
MOW, THEREFORE, based on the clear and convincing evidence supporting the foregoing findings it
is ORDERED, ADJUDGED and DECREED that Thelma L. Bonarrigo be and is hereby adjudged an
incapacitated person and Joseph H. Bonarrigo is hereby appointed Plenary Permanent Guardian of the
Person and the Estate of Thelma L. Bonarrigo.
Any Power of Attorney executed by Thelma L. Bonarrigo is hereby declared null and void and shall
have no legal effect.
A Report by the Plenary Guardian shall be filed on an annual basis with the Court.
IVo bond shall be required of the Plenary Guardian named herein.
'The Plenary Guardian is hereby authorized to make decisions on Thelma L. Bonarrigo's behalf
concerning her medical care and treatment including her admission to nursing homes, personal care
facilitie>, hospitals and other healthcare providers, as well as to consent to and authorize medical treatment;
and they Plenary Guardian herein appointed is further authorized to handle all of the assets of her Estate
including the principal and interest, and to conduct her business affairs on her behalf, including the sale or
transfer of any of her assets, payment of bills and expenses, investment of assets and all matters related
thereto.
