MUNICIPAL LIEN FOR SEWER SERVICES
North Middleton Authority, North Middleton Township, County of Cumberland, Commonwealth of
Pennsylvania by its solicitor, Martson Deardorff Williams Otto Gilroy & Faller, hereby files its
claim for sewer services against the real estate hereinafter described and sets forth its claim as
follows:
STATEMENT OF CLAIM
The name of the municipality by which this claim is filed is North Middleton Authority, a municipal
authority of the Commonwealth of Pennsylvania, located in the County of Cumberland and
organized pursuant to ordinances of North Middleton Township.

The name or names of owner or owners or reputed owner or owners, of the property against which
this claim is filed is Shillington Associates, a Pennsylvania general partnership, of 7300 Derry
Street, Harrisburg, Pennsylvania.
A description of the property against which this lien is filed is attached hereto and marked as
Exhibit "A."

The authorities under and by virtue of which this lien is filed is the Municipal Claims and Liens Act
of May 16, 1923, P.L. 207, as amended and supplemented, 53 P.S. 7101 et seq.

The lien is claimed for unpaid connection charges for 40 lateral connections within the Shillington
Development Plan, the legal description for which is attached hereto and marked Exhibit "A." The
connection fee is $3,100.00 per lot for 40 lots. The total lien claimed is $124,000.00. The specific
lots of the Shillington Development Plan which are subject to this lien are as follows: 1, 2, 3, 4, 5, 6,
7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 42, 43, 44, 45, 46, 47, 48, 49, 50, 51, 52,
53, 54, 55, 56, 57, 58. This is an approved but unrecorded plan.

Interest is claimed on the above-mentioned amount from June 27, 2007.

hand paid, the receipt whereof is hereby acknowledged, the said Grantors do hereby grant and

BEING the some property Robert L. Noll and Mary E. Noll, his wife, granted and
conveyed to Robert L. Noll and Mary E. Noll, his wife, Grantors herein, by deed dated March 30,
2004 and reoorded in the Office of the Recorder of Deeds for Cumbeland County in Dead
Book 262, Page 2016.
Grantors hereby assign to Grantee, all their right, title and interest in storm sewer
easements and sewer easements, which were reserved by Grantors in Deed Book Y, Volume 35,
Page 72.
Power of Attorney for Mary E. Noll is recorded in Cumberland County Miscellaneous
Book 151, Page 350.
AND the Grantors hereby covenant and agree that they will wamtnt specially the property
hereby conveyed.
