COMPLAINT IN MORTGAGE FORECLOSURE
AND NOW come the plaintiffs, Alfred C. Burtnett and Janet Burtnett, by and through their
attorney, Nathan C. Wolf, Esquire, and set forth this complaint in mortgage foreclosure averring as
follows:
Plaintiffs, Alfred C. Burtnett and Janet Burtnett, hereinafter "Mortgagees", are
adult individuals residing at 6580 Greenan Drive, Avalon, New Jersey 08202.
2. Defendant, Hutch Homes, Inc., hereinafter "Mortgagor", is a Pennsylvania
Corporation doing business within the Commonwealth of Pennsylvania and has its principal place of
business at 414 S. York Street Rear, Mechanicsburg, Pennsylvania 17055.
3. Mortgagees bring this action to foreclose the mortgage dated August 2, 2007,
between Mortgagor and Mortgagees, which was recorded August 3, 2007 in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania in Mortgage Book 1913, Page 831.
4. The mortgage secures Mortgagor's note dated August 2, 2007 in the amount of
$200,000.00, payable to Mortgagees in monthly installments with simple interest at the rate of 4 1/2
percent per annum.
5. The following is a description on of the land subject to the mortgage:
ALL THAT CERTAIN tract or parcel of land being situate in Lower Allen Township,
Cumberland County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the southern dedicated right-of-way line of Ravenwood Road,
said point also being the southwest corner of Lot No. 32 of the hereinafter referenced Final
Subdivision Plan; thence along the southern line of said Lot No. 32, North 87 degrees 47 minutes 52
seconds East a distance of 178.18 feet to a point; thence along the southern line of Lot Nos. 33, 34,
and 35 of the hereinafter referenced Final Subdivision Plan, North 50 degrees 56 minutes 00
seconds East a distance of 272.40 feet to a point, said point being the northwest corner of lands now
or formerly Robert J. Horst and Katheryn A. Horst; thence along the western line of said Horst
lands South 37 degrees 07 minutes 02 seconds East a distance of 167.73 feet to a point on the
northern line of lands now or formerly Gregory S. Lesher; thence along the northern line of said
Lesher lands and along the northern line of lands now or formerly Robert J. Moore, South 63
degrees 40 minutes 49 seconds West a distance of 259.83 feet to a point on the eastern line of Lot
No. 30 of the hereinafter referenced Final Subdivision Plan; thence along the eastern line of said Lot
No. 30 North 18 degrees 01 minutes 43 seconds West a distance of 30.00 feet to a point; thence
along the same South 72 degrees 39 minutes 16 seconds West a distance of 90.42 feet to a point;
thence along the northern line of Lot No. 29 of the hereinafter referenced Final Subdivision Plan,
South 87 degrees 47 minutes 52 seconds West a distance of 159.68 feet to a point on the southern
dedicated right-of-way line of Ravenwood Road; thence along the southern dedicated right-of-way
line of Ravenwood Road North 02 degrees 12 minutes 08 seconds West a distance of 75.00 feet to a
point, the point and place of BEGINNING.
THE FORGOING legal description is in conformance with (i) the plan entitled "Phase 2
Final Subdivision Plan for The Manor at Fair Oaks," dated August 25, 2003, last revised August 19,
2004, Project Number 210544, recorded in the Office of the Recorder of Deeds of Cumberland
County, Pennsylvania in Plan Book 89, Page 120; and (ii) the plan entitled "Revised Phase 2 Final
Subdivision Plan for The Manor at Fair Oaks," dated January 11, 2005, Project Number 210544,
recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania in Plan Book
90, Page 76.
BEING Lot No. 31 depicted on the aforementioned Phase 2 Final Subdivision Plan and
Revised Phase 2 Final Subdivision Plan.
HAVING a municipal address of 5023 Ravenwood Road, Mechanicsburg, Pennsylvania.
BEING THE SAME PREMISES which Jorich Land Development Corporation, a
Pennsylvania Corporation, by deed dated June 30, 2005 and recorded in the Recorder of Deeds
Office of Cumberland County, Pennsylvania in Deed Book 269, Page 3486, granted and conveyed
unto Hutch Homes, Inc., Mortgagor herein.
UNDER AND SUBJECT to restrictions and covenants, easements, and the like, of record
or visible by on site inspection.
TOGETHER WITH all the improvements now or hereafter erected on the property, and
all easements, appurtenances, and fixtures now or hereafter a part of the property. All replacements
and additions shall also be covered by this Security Instrument. All of the foregoing referred to in
this Security Instrument as the "Property".
6. Mortgagor is the real owner of the land subject to the mortgage.
7. The mortgage is in default because of Mortgagor's failure to complete the required
improvements on the property and to market said improvements for sale within a reasonable period
of time.
8. On or about May 28, 2009, counsel for Plaintiff communicated with Defendant's
legal counsel and set forth a written demand to complete the required improvements on the
mortgaged premises and to prepare the property for sale by June 15, 2009. A true and correct copy
of this communication is attached hereto as Exhibit "A".
9. Defendant was thus notified that its failure to perform by the June 15, 2009 deadline
would place Defendant in default of the mortgage and the failure to cure said breach would result in
the filing of the instant foreclosure action.
10. On or about June 5, 2009, the Defendant, through counsel communicated to the
Plaintiff, through the undersigned counsel, that the notice of May 28, 2009 was received and
acknowledged and that the Defendant it would be unable to cure the breach of the mortgage within
the allotted time. A true and correct copy of this communication is attached hereto as Exhibit "B".
11. Plaintiff has provided Defendant a reasonable opportunity to comply with the terms
of the mortgage and Defendant has failed to perform its obligations.
12. Defendant's failure to perform as required under the agreement within a reasonable
period of time constitutes a default of said mortgage and Plaintiff is entitled to pursue foreclosure of
said mortgage.
13. As a result of said breach, Plaintiff respectfully demands judgment in its favor and
against the Defendant and requests entry of an Order providing therefor.
WHEREFORE, plaintiffs, Alfred C. Burtnett and Janet Burtnett, request that this
Honorable Court enter judgment of mortgage foreclosure against the mortgaged property for the
amount set forth above, together with interest and costs of this action, and any additional relief the
Court deems appropriate and just.

I have been directed by my clients, Alfred and Janet Burtnett, to communicate with you
concerning the 2007 mortgage held by my clients on the above-referenced property.
Since so much time has passed since the execution of the mortgage and the construction on
the premises is not yet complete, I have been directed to notify your client, through you of a
deadline for completion of construction of the improvements of June 15, 2009 so that the property
may be listed for sale.
If this demand cannot be met, we will consider this loan to be in default, as your client has
had nearly two years on this mortgage and nearly four years on the first mortgage to complete the
improvements. I am requesting you notify me in writing of your client's intention to cure this
default by the June 15, 2009 deadline at your earliest opportunity. If your client cannot cure the
default, I intend to prepare and file a complaint in foreclosure on the 2007 mortgage.
Should you have any questions in this regard, please do not hesitate to contact me. I look
forward to receiving your response on as to your client's intention to cure the default and avoid
foreclosure.
