premises commonly known as LOT 47 EMI,YN LANE, Township UPPER ALLEN, CUMBERLAND
County, Pennsylvania, as set forth in ~e deed dated , recorded at Deed Book
, Page , La the R~corder's Office for CUMBERLAND County, Pennsylvania, as more
apeclfically described in Exhibit "A" which is incorporated herein and a~ached hereto.
NOW, May 10, 2004, at the time of a~d immediately before the execution of the principal
cOn~xact, m~d before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials fqr the same in consideration of the making of the said
contract with Contractor and the further comiderafion of One Dollar ($1.00), to Contractor paid by Owner,
ir is agreed that no lien shall be filed agalnnt the building by the Ctmtractor, or airy subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or tnareriais purchased, or extra
labor or mater/als purchased for the erection of said building, the right to/'de such Hens being expressly
wa/red.

ALL THAT CERTAIN lot in the property known, named and
identified in the Declaration, referred to below, as "Lindenwood"
located in Upper All~n Township, C~/mberla~d County, Pennsylvania,
which has heretofore been submitted to the provisions of the
Pennsylvania Uniform Planned Community Act, 68 Pa.C.S.A. Sections
5101 et seq., by the recording in the Office of the Recorder of
Deeds of Cumberland County, ~ennsylv.ania, the Declaration for
Lindenwood ("Declaration"), dated August 28, 1997, recorded
August 28, 1997, in Misc. Book 55S, Page 806, being designated in
such Declaration as Lot No. 4? (Identifying Number), described in
Section 2.2 of the Declaration and shown ~and described) in
Exhibit E of the Declaration.
