On or about August 15, 2006, Plaintiffs entered into a verbal contract with Defendant for the installation of an E.P. Henry terrace wall with caps (Dakota blend) color by Defendant on the Plaintiffs' property. 4. The price for the work to be performed under the terms of the agreement of August 15, 2006, was $4,650.00. 5. Subsequent to the installation of the terrace wall, the Defendant was paid the full the amount of $4,650.00. COUNTI BREACH OF CONRACT 6. Incorporate herein by reference all prior paragraphs and all subsequent paragraphs of this Complaint. 7. Defendant breached the agreement for the installation of the E.P. Henry terrace wall with caps (Dakota blend) color in that the work performed by the Defendant was not performed in a proper workmanlike manner in that: (a) Improper construction materials were used (b) Improper drainage provided during construction (c) Improper or inadequate excavation during the installation of the wall 8. As a result of the breaches of the agreement in the installation of the terrace wall, Plaintiffs will incur additional costs to have the work performed by Defendant corrected. 9. As a result of the breach of the contract for the installation of the E.P. Henry terrace wall with caps (Dakota blend) color, Plaintiffs are entitled to damages for the cost of repair and completion of the work that was improperly performed by the Defendant. WHEREFORE, Plaintiffs request that judgment be entered in their favor in an amount not in excess of the amount required for referral to arbitration according to local rules, plus interest and costs incurred. Defendant failed to complete, in a workmanlike manner, the installation of the E.P. Henry terrace wall with caps (Dakota blend) color. 12. As a result of the negligence of Defendant, the Plaintiffs are entitled to damages for the cost of repairing and completing the work that was improperly performed by the Defendant.
