Garner of Cumberland County, Commonwealth of Pennsylvania, entered into a contract with Michael D. Hansen, Building & Remodeling of Cumberland County, Commonwealth of Pennsylvania, to provide materials and perform labor necessary for completion of a residential dwelling situate upon lot of ground located: Lot No. 1, Hoy Road, Carlisle, Pennsylvania 17015, North Middleton Township, Cumberland County, Commonwealth of Pennsylvania, as more particularly set forth in Exhibit "A" attached hereto. NOW THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or material man, nor any other person furnishing labor or materials to the said contractor under this contract shall file a line for work done or materials furnished to the said building or any part thereof. This Stipulation is made and intended to be filed with the Cumberland County Prothonotary within ten (10) days after date, in accordance with the requirements of the Act of Assembly of Pennsylvania, in such case provided. The General Contractor hereby agrees to waive any defects in the filing and indexing of this Lien Waiver in the Office of the Prothonotary where it is to be filed pursuant to Section 1402 of the Mechanics Lien Law of 1963 and agrees that it will not contest the validity of this Lien Waiver based upon any such defects and hereby agrees to this waiver of defects on behalf of any of the Subcontractors, materialmen or suppliers that may provide any labor or materials under the General Contractors Agreement with the Owner and who, but for the same waiver, would be entitled to assert Mechanics Liens against the Owners property under the Mechanics Lien Law of 1963. Hansen, Con ractor ALL THAT CERTAIN tract of land situated in North Middleton Township, Cumberland County, Commonwealth of Pennsylvania, more specifically bounded and described as follows, to wit: BEGINNING at a point in the centerline of Hoy Road (T-498) being a corner in common with lands now or formerly of Girard E. and Carolyn G. Cunningham, said point also being the southeastern comer of this herein described parcel; thence leaving the aforementioned roadway and along the said lands South eighty-one (81) degrees nine (09) minutes fifteen (15) seconds West, a distance of two hundred and zero one-hundredths (200.00) feet to a concrete monument; thence by the same South eight (08) degrees fifty (50) minutes forty-five (45) seconds East, a distance of one hundred and zero one-hundredths (100.00) feet to a concrete monument being on the line of lands now or formerly of James D. and Lisa D. Dymski; thence along said lands and lands now or formerly of Lewis E. and Elizabeth A. Stoneberger South eighty-one (81) degrees nine (09) minutes fifteen (15) seconds West, a distance of one thousand three hundred eleven and eighty-seven one-hundredths (1,311.87) feet to a stone; thence along the same North thirty-six (36) degrees twenty-seven (27) minutes eleven (11) seconds West, a distance of five hundred thirty-three and twenty-eight one-hundredths (533.28) feet to an iron pin being a corner in common with lands now or formerly of Paul E. Geftel and Annette K. Burns; thence along said lands North sixty-four (64) degrees fifty-eight (58) minutes twenty-six (26) seconds East, a distance of one thousand eight hundred eighteen and twenty one-hundredths (1,818.20) feet to a point being in the centerline of Hoy Road; thence following said centerline of Hoy Road by the following five (5) courses and distances: (1) South twelve (12) degrees forty-eight (48) minutes forty-seven (47) seconds East, a distance of two hundred thirty-five and twenty-nine one-hundredths (235.29) feet to a point; (2) South fourteen (14) degrees thirty-eight (38) minutes zero (00) seconds East, a distance of ninety-six and seventy one-hundredths (96.70) feet to a point; (3) by a line curving to the right having a radius of 700.00 feet, an arc length of 105.78 feet, a chord bearing of South ten (10) degrees eighteen (18) minutes fifteen (15) seconds East, and chord length of 105.68 feet to a point; (4) South five (05) degrees fifty-eight (58) minutes thirty (30) seconds East, a distance of one hundred forty-three and twenty-three one-hundredths (143.23) feet to a point; (5) South seven (07) degrees ten (10) minutes forty-two (42) seconds East, a distance of two hundred ninety-nine and seventy-two one-hundredths (299.72) feet to a point being the place of BEGINNING. CONTAINING gross acreage of 1,206,156 square feet or 27.690 acres, more or less. BEING LOT NO. 1 of the "Final Minor Subdivision Plan for Frank W. Linsenbach, III and Wendy Hansen" as recorded in Plan Book Instrument #200817050 in the Office of the Recorder of Deeds in and for Cumberland County. Said plan prepared by Burgert & Associates, Inc., plan dated January 9, 2008 and last revised on February 12, 2008. BEING THE SAME PREMISES which Wendy K. Hansen and Michael D. Hansen, husband and wife, by deed dated February 2, 2009 and recorded February 4, 2009 in the Cumberland County, Pennsylvania Recorder of Deeds Office to Instrument Number 200903038, granted and conveyed unto Amanda R.
