Kaercher, Jr., by and through his attorneys, Laguna Reyes Maloney, LLP, and represents as follows: 2. 3 4. Plaintiff, Donald J. Kaercher, Jr., is an adult individual currently residing at 145 Cricket Ln., Camp Hill, Cumberland County, Pennsylvania 17011. Defendant, Sharon A. Kaercher, is an adult individual currently residing at 145 Cricket Ln., Camp Hill, Cumberland County, Pennsylvania 17011. Plaintiff is a bona fide resident of the Commonwealth of Pennsylvania and has been so for at least six months immediately prior to the filing of this Complaint. Plaintiff and Defendant were married in Maryland on April 25, 1992. 5. Plaintiff is a citizen of the United States of America. 6. Neither party is a member of the Armed Forces of the United States of America or its Allies. 7. Plaintiff avers that there are two minor children of the parties, namely Jill M. Kaercher, born October 2, 1993 and Mark. A. Kaercher, born March 24, 1996. 8. The marriage is irretrievably broken: Plaintiff and Defendant have lived separate and apart since March 15, 2009, and continue to live separate and apart as of the date of filing this Complaint. 9. There have been no prior actions of divorce or for annulment between the parties. 10. Plaintiff has been advised that counseling is available and that Plaintiff may have the right to request that the Court require the parties to participate in counseling. Knowing this, Plaintiff does not desire that the Court require the parties to participate in counseling. 11. Plaintiff requests the Court to enter a decree of divorce. COUNTI CLAIM FOR EQUITABLE DISTRIBUTION 12. Paragraphs 1 through 11 are incorporated herein by reference as if set forth in their full text. 13. Plaintiff and Defendant are joint owners of various items of realty, personal property, furniture, and household furnishings acquired during their marriage which are subject to equitable distribution. 14. Plaintiff and Defendant have incurred debts and obligations during their marriage which are subject to equitable distribution. WHEREFORE, Plaintiff prays that a judgment be entered in favor of the Plaintiff against the Defendant as follows: a. That a decree in divorce be entered divorcing Plaintiff from the bonds of matrimony between the said Plaintiff and Defendant; b. As to Count I, that this Honorable Court enter a decree equitably dividing the parties' property and equitably apportioning the debts incurred by the parties; and c.
