THIS AGREEMENT made the 13"' day of May, 2004, by and between Lawmen
Construction, LLC hereinafter referred to as Contractor, and Keith W. Sheriff and Barbara A.
Sheriff; hereinafter referred to as Owner, whereby the former undertook and agreed to erect and
construct a custom built home on that certain lot of ground situate at Lot 12 Deerview Drive,
Newville, Upper Frankford Township, Cumberland County, Pennsylvania, known as more fully
described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the stun of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

of Lot 12 Deerview Drive, Newville, Pennsylvania and that they as such owners, executed the
foregoing statement for the purposes therein contained by signing their names.

ALL THAT CERTAIN tract of land situate in ~Jpper Frankford Township, Cumberland County,
Pennsylvania, bounded and described in accordance with a subdivision plan prepared by Eric
Diffenbaugh, RPLS dated June 9, 2003 and recorded in the Office of the Recorder of Deeds for
Cumberland County in Plan Book 88, Page 79, as follows:
BEGINNING at a point in western edge of Deerview Drive at Lot'No. 13; thence along Lot No. 13
South 45 degrees 48 minutes ¢2 seconds West 467.72 feet to an iron pin set; thence along lands now
or formerly ofR. Dt~ane Wickard North 43 degrees 03 minutes 29 seconds West 180.04 feet to an
iron pin set; thence along Lot No. 14 North 45 degrees 48 minutes 22 seconds East 464.15 feet to
a point; thence along southern edge of Deerview Drive on plan South 44 degrees 11 minutes 38
seconds East 180.00 feet to a point, the Place of BEGINNING.
CONTAINING 1.9253 acres and designated as Lot No. 12 of Brick Church Estates.
