THIS AGREEMENT made the 13th day of May, 2004, by and between Lawmen
Construction, LLC hereinafter referred to as Owner, and Keith W. Sheriff, hereinafter referred to
as Contractor, whereby the former undertook and agreed to erect and construct a custom built home
on that certain lot of ground situate at Lot 9 Deerview Drive, Newville, Upper Frankford Township,
Cumberland County, Pennsylvania, known as more fully described in Exhibit "A" attached hereto
and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN tract of land situate in Upper Frankford Township, Cumberland County,
Pennsylvania, bounded and described in accordance with a subdivision plan prepared by Eric
Diffenbaugh, RPLS dated June 9, 2003, and recorded in the Office &the Recorder of Deeds for
Cumberland County in Plan Book 88, Page 79, as follows:
BEGINNING at a point in the centerline of Center Road, SR 4008 at comer of Lot No. 10 on
said plan; thence along centefline of Center Road, SR 4008 North 54 degrees 13 minutes 37
seconds East 173.55 feet to a point; thence along the western right of way line of Deerview Drive
South 35 degrees 14 minutes 4l seconds East 24.93 feet to an iron pin set; thence along western
right of way of Deerview Drive by a curve to the right having a radius of 25.00 feet, an arc
distance of 38.92 feet, on a chord bearing of South 80 degrees 388 minutes 03 seconds East;
