STIPULATION AGAINST LIENS
THIS AGREEMENT made the V day of July, 2009, by and between Daryl L. Young
Builder, hereinafter referred to as Contractor,
AND
Michael J. Monnett and Summer D. Monnett, hereinafter referred to as Owners, whereby the
former undertook and agreed to erect and construct a building on that certain lot of ground situate in
Penn Township, Cumberland County, Pennsylvania and being more commonly known as Lot 1,
Centreville Road, as more particularly described in Exhibit "A" attached hereto and incorporated
herein by reference.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of ($1.00) Dollar to it in hand paid by Owners, the receipt whereof
is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
itself and its subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by it or any of its subcontractors against the
said buildings and the lot of ground appurtenant thereto for or on account of any work done or
materials furnished by it or any of its subcontractors under said contract or otherwise, for, towards,
in, or about the erection and construction of the said buildings on the lot above described, and the
said Contractor, for itself, its subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an
independent covenant.

ALL THAT CERTAIN lot or piece of ground situate in Penn Township, County of Cumberland,
Commonwealth of Pennsylvania, more particularly bounded and described in accordance with a survey by
John R. Kissinger, dated February 14, 2006, recorded in the Office of the Recorder of Deeds in and for
Cumberland County as Plan Book 93, Page 115.
BEGINNING at a point at the corner of Lot No. 2 of the aforesaid Plan; thence along Lot No. 2 North 84
degrees 22 minutes 50 seconds West 49.48 feet to a point; thence continuing along Lot No. 2 North 84
degrees 22 minutes 50 seconds West 457.30 feet to a point at the corner of Lot No. 2 and the line along Lot

Right of Way
Pursuant to the notes on Page 2 of the aforementioned Plan, "Legal title to the right-of-way shall be
conveyed by separate legal description to the owner of Lot 1," thereby being bounded and described as
follows:
BEGINNING at an existing iron pin at the northeast corner of said private right of way and L.R. 21004 (Pa.
Route 233); thence along L.R. 21004 (Pa. Route 233) South 10 degrees 32 minutes 6 seconds East 51.65 feet
to an existing iron pin; thence Lot No. 2 of the aforementioned Plan North 86 degrees 28 minutes 36 seconds
West 488.17 feet to an existing iron pin; thence continuing along Lot No. 2 North 3 degrees 27 minutes 46
seconds East 137.46 feet to a set iron pin at the lands of Lot No. 1 of the aforementioned Plan; thence along
Lot No. 1 South 84 degrees 22 minutes 50 seconds East 49.48 feet to a set iron pin at the corner of lands
now or formerly of the Conference of the United Methodist Church; thence along said lands of the
Conference of the United Methodist Church South 3 degrees 17 minutes 36 seconds West 86.04 feet to an
