Herb, hereinafter called the Owner, is about to execute contemporaneously with Talon Landreth, Northwood Craftsmen of 1340 Baltimore Road, Shippensburg, PA 17257, hereinafter called the Contractor, a contract for the erection or construction of a SINGLE FAMILY DWELLING upon the lot of ground known as Lot #1 Whitmer Road, Shippensburg, PA 17257Southampton Township, Cumberland County, Pennsylvania, described in Exhibit "A" hereof, of which Gregory P. Herb is the title holder of record, as more particularly described in Deed Book , Page ; and Now, June 1, 2009, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the Owner to the Contractor to commence work on said building or improvement, to purchase materials for the same, it is hereby stipulated and agreed by and between said parties as part of said contract and for the consideration therein set forth, nether the undersigned Contractor, any Sub-contractor or material man, nor any other person furnishing labor or materials to the said Contractor under the contract entered into between said parties shall file a lien for work done or material furnished to said building, improvements or any part thereof. This stipulation is made and intended to be filed with the Prothonotary within 10 days after date in accordance with the requirements of the Act of August 24, 1963, P.L. 497, as amended, In Witness Whereof, the said parties have hereunto set their hands and seal the day and year aforesaid. Gregory P. e Northwood Craftsmen By: Talon Landreth Exhibit A ALL THAT CERTAIN lot or piece of ground situate in Southampton Township, County of Cumberland, Commonwealth of Pennsylvania, bounded and described as follows: BEGINNING at a point, a set railroad spike in the existing right of way of Township Road T-314 (Whitmer Road) at common corner of Lot 2 and Lot 1 on subdivision plan for Robert and Atha Jones, filed March 9, 1995 in Cumberland County Plan Book Volume 69, Page 114; thence over the public right of way of Township Road T-314 (Whitmer Road) and crossing Thompson Hollow Road South 50 degrees 01 minutes 44 seconds West 385.28 feet to an existing stone pile (also known as State corner No. 18); thence crossing Township Road T-314 (Whitmer Road) and along lands now or formerly of Edgar J. Coy North 14 degrees 54 minutes 51 seconds East 471.00 feet to a set iron pin; thence along Lot 2 as shown on the aforesaid subdivision plan South 39 degrees 58 minutes 16 seconds East 270.93 feet to a set railroad spike in the public right of way of Township Road T-314 (Whitmer Road), the point and place of BEGINNING. BEING all of Lot No. 1 as shown on Subdivision Plan for Robert and Atha Jones, filed March 9, 1995 in Cumberland County, Pa., Plan Book Volume 69, Page 114. BEING the same premises which Michael W. Wingert and Renee L. Wingert, his wife, by Deed dated April 30, 2009, and recorded May 11, 2009, in the Office of the Recorder of Deeds in and for the County of Cumberland, Pennsylvania, as Instrument No. 200915297, granted and conveyed unto Gregory P.
