WHEREAS BRANDON SHOEMAKER AND KAYLA CARROLL entered into a contract with
BRANDON SHOEMAKER AND
to provide materials and/or to perform labor necessary for the construction and erection or he alteration and repair of

County, Pennsylvania, being more particularly bounded and described as follows:
Deed from Interfaith Housing Alliance, Inc. Dated G-a5-09 and intended to be
recorded preceding the recording of this stipulation to Brandon Shoemaker and Kayla Carroll.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said
contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or
materialman, nor any other person furnishing labor or material to the said contractor under this contract shall file a lien,
commonly called a mechanic's lien, for work done or materials furnished to the said building or any part thereof.
This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in
accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided (49 P.S. 1402).

ALL that tract of land in Southampton Township, Cumberland County, Pennsylvania,
being more particularly described as follows:
BEGINNING at an iron pin on the western right-of-way line for Walleye Drive at the
corner of Lot No. 38 on the hereinafter described subdivision plan; thence by said Lot
No. 38, North 79 degrees 17 minutes 46 seconds West, 180.96 feet to an iron pin at
corner of stormwater easement; thence by said stormwater easement, North 10 degrees
42 minutes 14 seconds East, 125.88 feet to a set concrete monument on line of land now
or formerly of Roy M. Mellinger; thence by said land now or formerly of Roy M.
Mellinger, North 60 degrees 42 minutes 00 seconds East, 55.61 feet to an iron pin at
corner of Lot No. 40 on the hereinafter described subdivision plan; thence by said Lot
No. 40, South 52 degrees 00 minutes 45 seconds East, 177.59 feet to an iron pin in the
western right-of-way line of Walleye Drive; thence in and along the right-of-way line of
Walleye Drive, by a curve to the left on a circle having a radius of 175.00 feet, for an arc
distance of 83.33 feet, the chord of which is South 24 degrees 20 minutes 44 seconds
West, 82.55 feet to an iron pin in the western right-of-way line for Walleye Drive, the
point of BEGINNING.
THE above description was taken from a final subdivision plan for North Middle Spring
Estates by Eric L. Diffenbaugh, Professional Land Surveyor, which plan is recorded in
the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan
Book 91, Page 61.
THE above described tract of land is identified as Lot No. 39 on said plan.
