AND NOW, COMES The Law Offices of Peter J. Russo, P.C., attorneys for the
Estate of Rosalie S. Armento and Executor, David Armento, (hereinafter "Counsel") and
files this Motion to Withdraw Petition for Court Approval to Withdraw as Counsel for the
Estate of Rosalie S. Armento and Cancel Hearing, and in support thereof, states the
following:
1) On or around July 1, 2009 Counsel filed a Petition for Court Approval to
Withdraw as Counsel for the Estate of Rosalie S. Armento.
2) On or around July 7, 2009 the Honorable Judge Edward E. Guido issued
an order scheduling a hearing for Friday, July 24 for the Administrator David Armento
to show cause why the Petition should not be granted.
3) On or around July 9, 2009 the Administrator and Counsel spoke and
Counsel agreed that if Administrator provided the- necessary information to finalize the
estate Counsel would withdrawal their Petition.
4) On or around July 23, 2009 Administrator provided the required
documents and information to complete and signed the Revenue 1500 to finalize the
estate which has been simultaneously filed with this Motion.
WHEREFORE, the Law Offices of Peter J. Russo, P.C. respectfully requests this
Honorable Court to grant its Motion to Withdraw Petition for Court Approval to Withdraw
as Counsel for the Estate of Rosalie S. Armento and Cancel Hearing .which was
scheduled for July 24, 2009 for the Estate of Rosalie S. Armento in the above-captioned
matter as the estate as since we finalized.
